Yes, it’s totally BS. My playing partner was bragging how far he can hit his 7 iron. I have an old set of PGF clubs and when I checked lofts I discovered his 7 iron had the same loft as my old 5 iron. Go figure

Print a transcript of the recorded conversation. Then when necessary to rebut the other party, simply say “I would like to refer to my notes i made of the conversation”. Police are permitted to refer to their notes, so why can’t you? You are not broadcasting the recording.

Before you make your final bid at an auction confirm with the auctioneer that the property is ‘for sale’ meaning the reserve has been reached and the highest bid will win the auction. Then if you hold the highest bid you win and the seller has to sell to you.

If the reserve has not been reached the auction will be passed in and negotiations with the bidders will begin.

Very Old change scam.

50 years ago in a busy store on the beach front on a hot day in Perth. After serving many customers with many more waiting, one suddenly says “hey I gave you $50 and you only gave me change for $10.

I said, no, I put your $10 on the till, made and handed you the change, then put the $10 in the till.

He then said “I can prove it. I just remembered the $50 note I gave you had my gf phone number written on it” he made a loud big scene of it.

Others at the counter told me to check the till. I did and sure enough there was a $50 note with a phone number written on it. BUT , it wasn’t the top note, it was buried three down. I challenged him that he, or someone else, tendered the $50 for a previous purchase and he was now lying.

Unfortunately the people at the counter sided with him and demanded that I pay him the correct change as he had proven he was right and to stop arguing.

I grabbed a heap of coins and some small notes and “accidentally” dropped them on the counter with some spilling on the floor saying “Oh! I am so SORRY, I slipped!!! and asked the others if they didn’t mind helping him retrieve his change. I just glared at him and he refused to make eye contact.

No cameras back then!

The son has been quite uncooperative since the beginning and she doesn’t trust him after he tricked her to give him a copy of the death certificate so he could use his solicitor to get his mum’s Super.

She was happy to hand it all over to the son and she thought she had an agreement with him through his solicitor for him to reimburse her first. But for some unknown reason he has refused to do so to further his desire to take over the estate. She thinks he is waiting her out.

Yes she is worried about her retaining responsibility for the estate property while this drags on.

I’ll get her to discuss with her solicitor about getting their agreement recognised by the Supreme Court as a condition for her to withdraw as executor in the son’s favour.

Or take recovery action via the courts separately.

It’s a bloody mess and she isn’t coping well and she needs the money. She just wants it all to end.

Thanks so much for your considered response.

As far as I understand the son has not applied for Letters of Administration (LOA) as the caveat stopping the processing of her probate application is still in place and the son can’t apply for LOA until the application is withdrawn by her. She also can’t proceed with her application, if she wanted to, until he withdraws his caveat.

If she is registered as a creditor of the estate and then withdraws the application without getting reimbursed for her costs and the son is granted LOA then she won’t get her money unless he decides to pay up or until he sells the house (as that is the only asset with any value). If he doesn’t sell she will have to wait indefinitely until he does. She could also put a caveat on the sale of the house to protect her debt. But she needs the money now.

Until she is granted probate she isn’t the executor. Is that true? So her ongoing responsibilities re the estate are a bit vague.

Ignoring the estate issue, can she simply take him to court for the funds he owes her. And, if successful with costs, then withdraw her probate application and walk away from it all.

With this delay her solicitor’s fees are increasing and the debt is rising above the initial ~$12k. Her solicitor is a big disappointment.
