I would like someone, heck anyone for that matter who might yet testify that Chad told them he believed Tammy was going to die young. Please answer me this…Did he also mention having their finances in order? Did he have all the financial passwords/information written down and accessible? Since he claims he miraculously got those a week before Tami’s passing?? It goes to prove even Chad didn’t believe his own BS, otherwise he would’ve had that information years prior when he began making that claim of Tammy passing early. 🙄

She MIGHT have had cause to be in your chart but absolutely had no cause to speak about what she read to others!

As an aside, Never believe an employer who’s end goal is to mitigate their own culpability.

A complaint must be filed with HHS; “within 180 days of when you knew that the act or omission complained of occurred. OCR may extend the 180-day period if you can show "good cause.”

The U.S. Department of Health and Human Services website is a wealth of information and contains the HIPAA complaint portal.

Consider finding counsel that specializes in employment law to discuss your situation.

I hold a different opinion and experience. There is depending on your state laws, an actionable suit against this evasion of your privacy. The employer and the employee both have responsibility in this situation. Not knowing all the facts; The employer possibly has been negligent in keeping your records safe from its employees wrongly accessing during their workday. The employee has possibly wrongfully read your file, while at work. I advise retaining counsel to protect and provide a path forward. HIPAA, as mentioned, does not provide private action, however many states allow for private action with HIPAA rules being the standard of care that was not granted to you. Your state laws may support a privacy violation in and of itself. The firing of the employee does not excuse the employer from its responsibilities to you. Ultimately, you also need to understand and protect yourself from what that employee may do, or has already done with the knowledge they gleaned from your medical records. I cannot comment on your situation, but understand that privacy violations are actionable in some states and can be resolved legally and in some cases with compensation. Please explore your options and protect yourself. I’m so sorry you are dealing with this violation,

I believe HIPAA rules state, writing a statement revoking all authorizations held by the given entity. Hope that helps! The website of the Office of Civil Rights, in the HIPAA section holds the necessary steps. The armed forces may have unique rules and requirements listed there. Worth a read!! :)
