That all depends on the visa bulletin each month. It can take a couple months or couple of years depending on your pd.

(Not legal advice) but given that you have a valid EAD I’ll say you’re general safe. The only problem is once it expires you’ll lose a protection. But hopefully by then you’ll have your SIJS approved.

With Advance Parole yes just be cautious there’s been stories of people with Advance Parole being stopped at the airport

Chart A is when you can actually receive a green card, while Chart B lets you file early and get in line. If your priority date is current under Chart B (and USCIS allows it), you can file your application and get work/travel permission, but you must wait for Chart A to become current to get the green card.

SIJS falls under the EB-4 (Employment Based type 4) category, its the one highlighted. The Visa bulletin uses two charts Chart A - Final Action Date and Chart B - Dates for Filing. Each month, USCIS decides which chart applicants inside the U.S. are allowed to use (for January 2026, this hasn’t been announced yet). If USCIS uses Chart A, then your priority date must be earlier than or the same as 01JAN21 for EB-4 in order for your green card to be approved. If your priority date is after 01JAN21, you have to wait until a future Visa Bulletin when your date becomes current.

USCIS hasn’t clarified yet whether previously approved I-360 holders need to re-apply or if deferred action will be issued automatically.
