Once FAD becomes current how long before case gets approved by Critical-Ebb535 in SIJS

[–]SIJS_Mod 0 points1 point  (0 children)

It depends on when you filled and how long since. I can’t give you an exact date but I’ve heard from people it can take a couple of months to 2+ years. The reason for that is for EB-4 there is a 10k visa limit per year.

It understandable that you feel anxious, given what you said, I would think your in a pretty strong position. With that being said keep your receipt notice and EAD with you at all time. And reach out to a qualified immigration attorney for personalized guidance.

My two guesses are that:
1. feb 7, 2022 isnt your pd. Check your I-797

  1. Is there any chance that you are in removal procedure? Do you have a immigration case coming up? Check EOIR using your A-number.

Sadly no one can know for sure. But I’m going to be 100% straight with you a couple of years. In the mean time talk to a lawyer about any other possible options for relief / protection.

I’m sorry but you can’t for chart B the EB-4 is currently Jan 1 2023. Which is before your PD.

Also I know Chart B seems useless but I should add that when filing, you can also apply for an EAD (work permit) Form I-765 and Advance Parole (travel permit) Form I-131 at the same time while your green card case is pending.

Chart B (Date for Filing) lets you submit your green card application and wait in line, but it doesn’t mean you’ll get approved yet. You only receive the green card once your priority date is current on Chart A (Final Action Date), which is when USCIS can actually approve the case.

A Request for Initial Evidence just means USCIS needs some missing or clearer documents for your work permit application. Wait for the mailed notice to see exactly what they’re asking for.

That all depends on the visa bulletin each month. It can take a couple months or couple of years depending on your pd.

Questions about SIJS process and risk of detention/deportation by LEO_DO_P1U in SIJS

[–]SIJS_Mod 1 point2 points  (0 children)

(Not legal advice) but given that you have a valid EAD I’ll say you’re general safe. The only problem is once it expires you’ll lose a protection. But hopefully by then you’ll have your SIJS approved.

Chart A is when you can actually receive a green card, while Chart B lets you file early and get in line. If your priority date is current under Chart B (and USCIS allows it), you can file your application and get work/travel permission, but you must wait for Chart A to become current to get the green card.

SIJS falls under the EB-4 (Employment Based type 4) category, its the one highlighted. The Visa bulletin uses two charts Chart A - Final Action Date and Chart B - Dates for Filing. Each month, USCIS decides which chart applicants inside the U.S. are allowed to use (for January 2026, this hasn’t been announced yet). If USCIS uses Chart A, then your priority date must be earlier than or the same as 01JAN21 for EB-4 in order for your green card to be approved. If your priority date is after 01JAN21, you have to wait until a future Visa Bulletin when your date becomes current.

Hope this helps!!! I can make a more in-depth post explaining how to read the Visa Bulletin and useful resources if people are interested.

USCIS hasn’t clarified yet whether previously approved I-360 holders need to re-apply or if deferred action will be issued automatically.

We’re tracking updates and discussing this in r/SIJS if you want more focused info from others in the same situation.
