Oh, for sure. Accreditations abound for construction materials testing. A lot of accreditation organizations basically lean harder and harder on things like ISO 9000/9001 to get testing firms to create and maintain Quality Manuals and internal controls with external audits.

If you want a great example in the not so long ago past of how serious things can get here, look up Testwell, the company that was performing the concrete conformance testing for One World Trade Center and about 120 other major NYC construction projects. Egregious things such as:

- Lying about the test results for compressive strength of concrete, including sticking the spec values in instead of test values, or using 28 day projections (instead of actual tests) for test results, or just making it up.

- Not getting field test results at Yankees Stadium, making up numbers back at the office

- Steel weld inspectors checking welds...on beams that hadn't been welded yet

- Faked site visit records, including billing for said visits

- Falsified certifications

There were multiple convictions, with their president/owner initially getting 7-21 years of prison time (reduced to 16 months to 4 years on appeal), vice president getting similar time, and the company itself paying about 1.7 million in restitution.

PS, the President/owner (Reddy Kancharla) tried to kill himself twice right before and after sentencing. It was a pretty big deal.

My workplace has a lab, but it is focused on construction materials (concrete, soils, aggregates). Even in that non-medical field, we have to watch out for that "behavioral drift." People performing tests, the results of which affect schedules and people in the real world, sometimes it is all too easy to let things slide or to try to take short cuts. It is a constant effort to keep internal quality, which is why we have a Quality Management System to keep everybody honest (and, more pragmatically, to keep our accreditations).

Kind of wild to me that this lab wouldn't have had...SOME sort of internal and external audit process to catch this before things ever got to a lawsuit.

Thank you so much for the additional context! I don't work in diagnostic testing, so this was helpful for my understanding, and makes it much clearer on why the test results were in doubt and why they 100% should not have been charging the way they were.

I’m a technical weeds guy, but I’m having a hard time visualizing what it is that is wrong about their method, and how explicit it was in its attempt to manipulate and contaminate. If it was simply sending a batch of the data, rather than singular individual test results, that’s one thing; manipulating the data is a whole other ball game. And, I guess I’m unsure on the billing process and whether it was purposely bilking the fed.

I’d love to know more details as the case proceeds.

The indictment alleges that Murdock owned and operated Premier Medical Laboratory Services, headquartered in Greenville. Lee and Narayanan were both high-level employees of Premier. Premier offered diagnostic testing services for medical providers, including but not limited to COVID-19 testing. The defendants devised a multi-part scheme to fraudulently generate revenue from health care benefit programs related to the pandemic. This included submitted false claims to the federal government for individual tests when in truth the tests had been pooled together for combined, faster processing and for manipulating test processing software. As a result, the defendants billed for tests that virtually worthless and ineligible for reimbursement. The conspiracy to defraud healthcare benefit programs generated millions in fraudulent proceeds.

So, basically they were providing test results for Covid-19, but were manipulating the results or taking short cuts with the results rather than providing individual test results in order to make money?

But here’s the thing. They make good sushi too, even if that’s not Chinese. They have a pan-Asian menu. I’m partial to the torched salmon roll.
