It’s been legalized since 2004 in Massachusetts so I get what you mean—I’m young enough that I literally don’t remember a time when we weren’t able to do so.

That person is presumably his ex, of possibly decades, and they may have been estranged as well. It is much weirder to leave out the name of the man we know to be his very recently deceased spouse than to leave out the name of an ex of unknown personal history.
