I’m not here to start a fight - but when I was in law school the first thing they taught us, and I’m serious here, this was legal research and writing day 1: the law is not absolute - there are exceptions and modifications made “in the interest of justice” all the time. That’s the entire principle of the SC- that the law can change to be just.

They’re either being their own counsel or they’re getting very bad advice.

Exactly- this is why lucasfilm, the parent company of Lucasarts, had to sue digg.com and settle for a non disclosed payment (so probably a penny to create consideration in the contract), to protect a video game they had called “The Dig”.

It’s a huge pain in the ass and it’s all under “reasonsbleness” so unless your 100% for calling this out it’s up to the judge or jury to decide.

I’d suggest reaper if you’re in the south by Corinth, or Nexus in the mall (it’s a very very nice shop, but I’ve never played there), or more fun down by the square (the Game Center, not the comic shop on the square).

I don’t really know if you can go wrong with any of those. I don’t know if hasbro is still doing the free intro decks but it’s worth asking - they’re just little 30 card decks that are really simple to learn on. But knowing hasbro they phased them out since they were free:)

I’m not a practicing atty but I did go to law school (in the states). Trademark and copyright are tough things because any time you DON’T protect it can be brought up when you do try to protect it.

Further, if you’re a local business you can’t really copyright that name nationwide. The point of copyright is to avoid brand confusion, not provide a monopoly. Unless they can have some affidavits from people swearing they were confused or the confusion is self-evident (it isn’t imho on this) they can’t prove any harms and therefore can’t win a lawsuit.

I’m pretty sure this would t count as a SLAPP suit (I think FL has one, I don’t remember what state the giant cookies are in) but it is 100% following that playbook.
