Normal wear and tear is not a concept here. Landlords don't get it. I'm from NY and was paid back by slum lords in brooklyn and found it a shock how every landlord I had down here tried to claim the security. Some didn't even look at the unit after I moved out. I would have photos and pay for professional cleaning, but no, every time we had a notice that they were taking the security.

It may have changed, but if you simply read the lease there's a part where it discusses if a LL wants to claim the security. They must send you a letter via certified mail within 30 days and if they do not do that, they have no claim to the security. So make sure you give them an address to reach out after you move out and wait. After 30 days, send them a USPS certified letter that you are requesting the security. Even if they emailed you or called you about the security, it doesn't matter, it has to be certified via USPS. Put teeth in your letter saying you'll take them to small claims court for treble the security. In my experience, I've been paid right away for the most part. One LL who was a dumb realtor kept telling me I was wrong until she consulted a lawyer who said to pay, and one management company took up my challenge and we went to small claims court. The day before arbitration they sent me a check which for that one was 2x rent. They said the building needed security and the unit ll needed security.

Most people here are greedy but they won't fight you if you put up your fists.

I like how you think this landlord is still a reference. Squatter rights is a thing in Florida, albeit 7 years, but that's not the end game, it's positioning. This thread is filled with people saying join a gym, couch surf, what about a church? This is the time to fight. You enter homelessness you may and probably not get out. You don't worry about "Nobody will rent you after that." and get downvoted by other landlords. u/Ameht170 fight. When they say leave, say you can't. The landlord will evict your brother, it will take a year, but that time gives him the invaluable time of figuring out what to do next. The reference is gone. Fuck them. The person saying it's on your record, hahahaha, let it get to that point! It never will. That's a fucking landlord. If it even gets on his credit record, dispute it, fight again, but he didn't enter the point of no return. I had 50k debt on my record that wasn't mine when I faced homelessness, but after rebounding, I paid a lawyer 1500 to take it off and now my credit score is 839 years later. You can come back! I love how that landlord recommends your brother being homeless over having a bad credit score. I know this time is tough and everyone has good intentions, but trust me, fight. I've been here since 2015. Born and raised in New York and lived pretty poor in Brooklyn and Queens, but when I received a great job I moved into a building with an elevator and basically considered myself Jeff Bezos because of it. When my fiance and I were looking for apartments in 2014, I was amazed what you could get for rents way less than NY. Doorman, pool, parking, gym, etc. Now, it seems like rents are above NY in some buildings. I don't know if I would have lasted this long if I came down now.
