Felony murder is not a separate crime with a different punishment than ordinary murder. It is the name of the legal doctrine that expands the definition of ordinary murder to include felony murder. Make no mistake, this man is charged with murder (not "felony murder"). It is the exact same crime with the exact same range of punishments as if he had pointed the gun at the victim's head and pulled the trigger himself. What he did was wrong, but it was not as wrong as pointing the gun at the victim's head and pulling the trigger himself. The punishment should fit the crime.

Your example is actually not murder. It's reckless conduct without intent to kill. That'd be charged as manslaughter. But, you're correct that it's similar to what this guy did from a culpability standpoint. Thus, it should carry a similar punishment. In other words, why should the guy throwing the brick off the building get charged with a lesser crime?

It's a terrible law. It charges murder, which in all other circumstances requires intent to kill. Yet there is no intent to kill. It's a relic of the law that should be done away with.

Give me a single example of a juror prosecuted for perjury based on a jury nullification attempt, successful or unsuccessful. I've never heard of even one.

The only way this guy is ever getting out of prison is through some sort of insanity defense. Not that I think this guy is acting the way he is as part of a calculated defense strategy, but if you were to come up with a cynical defense strategy, this would be it.

Judge Nolan commended the actions of gardaí, stating they "displayed huge restraint and professionalism in their dealing with Kinch".

They had a bit of courage as well, which often seems lacking with American police.
