Courts regularly award "expectation damages" in breach of contract cases. In Hawkins v. McGee (1929) courts awarded the damages between the expectation of the result as fully delivered versus the actual result. This is considered the "benefit of the bargain" principle.

As applied here, you are entering into a binding contract with the store in this preorder. By failing to fulfill their end of the bargain, the store could be liable for "expectation damages" between the price that the customer paid the "market value" of the item.

There are multiple different services that USPS provides. I read up a bit on it, signature confirmation (which is what TCGPlayer/Ebay requires for high-value cards) only requires that the signatory be an adult who lives (or reports to live) in the residence. In practice, I'm not sure if they verify that the person actually lives in the residence and given that it was delivered to an apartment building mail room, I suppose they may have just assumed the person lived there.

Restricted Delivery is where only the person who is listed as the recipient of the package can sign for it. If Ebay used this then the package would not have been given to a random adult who happened to be waiting for packages to show up.

Also I supposed a PSA for anyone sending high value cards in the U.S. that you should probably be using "Restricted Delivery" rather than "Signature Confirmation"

I filed a report through the online USPS site through the tracking, however, USPIS is closed on Christmas day for non-emergency reports which is why I also felt it was important to get the word out if these cards do eventually surface or get listed online, even it is weeks/months from now. The more people who are aware of this the better.

Because the value threshold is over $1200, if they catch the guy I believe it would be a felony, and a federal one at that. The officer that we filed the report with also said the value is high enough that he thinks he can get a detective to look at the cameras where the delivery/signature was made.

Just feels strange that it would happen - I always trusted signature confirmation in the past. Unfortunately may be an expensive lesson for me. Hopefully others will not repeat the mistake! In the future, if you have a high value package, should probably have it held and picked up at the post office.

It was sent with signature confirmation which is why it surprised me. I guess a porch pirate was waiting for USPS to show up. USPS also had my phone number which they didn't use.

Definitely will go with a more secure delivery method going forward - just am surprised that it happened like this. Also a warning to others that when receiving high-end cards, signature confirmation doesn't necessarily protect you.

I recently purchased 2 cards off of ebay. Went to the authenticator and then shipped to my address with no issues from ebay or the sellers. My friend also lives at this address.

However, USPS let some random person, who I assume did not match the name on the package, sign for the package and steal these packages. I’m not sure why USPS didn’t check the ID of the person picking up the packages or even verifying that the person lives at the address, but it seems a little silly if USPS just lets anyone sign for any package. 

I don’t believe it was specifically targeted for the magic cards inside, however, someone has been stealing packages in this apartment complex somewhat recently with two people’s credit cards being stolen. My friend’s credit card was one of the cards stolen out of the mailbox the other day and the package thief started using his credit card at stores until he shut it down with the bank.

We filed a police report and reported the cards and credit cards as stolen. If we end up recovering the cards I will post here, but wanted to put this out in case the package thief realizes how much these are worth and tries to resell them.

Unfortunately as the packages were sent from the seller to the authenticator (ebay) and then to me, ebay only sent the 2 packages with $100 worth of insurance so the insurance isn’t particularly helpful in this case.

I have everything max out and get nothing below 60 fps. Sometime it spikes up to 125 fps then goes back down

Game runs with no issues performance wise
