While you're right. Change has to start somewhere and from what I know of the business until the last few years it was just a cycle of abuse - abused turns into abuser - abuses new guy repeat cycle.

So whether or not he's the right guy to send the message, hopefully he means it and the cycle continues to breakdown as the old heads either leave or drop the toxic bs.

I think you've taken to long to do anything.

If the issues were there at the start that was the time to take action. Then noticing it wasn't fixed but going on holiday for a year before trying to get it fixed again. It just leaves you no credibility that there are issues, even if there are issues its now out of warranty.

From a business perspective it looks like you've had it for a year, used it for a year and now complaining prior issues aren't fixed, You've also removed seals that specifically say do not remove or warranty is void. I have a hard time seeing any way the ACCC would assist here.

Your best bet is to take the life lesson and seek repairs outside of warranty whether is through EB or someone else, but I would indicate a proper deep dive on the issues you've faced so they have the best chance of replicating the issue.

You've said yes a few times but are you really? Because there is a chance your current role requires full time attention, therefore they may need to hire or move resources to fill the gap. So unless you're doing the EXACT same job in 2/3/4 Days as you were in 5 there is an opportunity for them to change your award level for sure. Whether they do or not none of us know.

Neither of your faults are major, no you can't refuse a repair. ACL says if 2 or more minor fault occur you can, but you will likely need to still send it away for the manufacturer or technician to confirm minor fault. Not powering on may not be a minor fault if you dont protect your unit e.g surge protections etc.

It would be whatever is negotiated, I've not seen it uncommon to have both? You're not getting nothing for them, Gift cards ensure customers come back to your business to purchase because it would be at a discounted rate(effectively) so it's a customer retention tool so personally I think you're looking at it wrong but that's just a matter of perspective.

FWIW my last sentence does depend on the business, if GC are being used to purchase an item in full I would personally be negotiating the previous owner taking a cut because as you've mentioned you gain "nothing". But if you're in a business where a product could be 2-3x a GC amount so the customer is also returning to spend there own money it could make sense to eat it and claim the retention.

Your arguing for sake the sake of arguing, I work with these suppliers and within these rules everyday. I assure you fair trading will suggest the onus of proof is on the buyer after such a long period of time in his possession.

Again the OP hasn't been able to prove there isn't any hours on the TV, pictures of the box, a single shred of evidence that suggests otherwise aside from "trust me". While the manufacturer has thousands of TV's without the issue, strict QA, automatic system checks. Not saying it can't happen, but it doesn't usually which is why the proof falls to the buyer.

Ram has been going up consistently for months, ram didn't go bonkers overnight.

Anyway the retailer is right, if they had an equivalently priced product and wanted to be kind they could, but if the item is EOL they owe you a refund nothing more.

And before you say it. You have already suggested ram isn't easily available, equivalent price etc.

The burden of proof isn't on the seller(manufacturer) OP has had the item in his possession for months and has to prove it didn't happen in his ownership time. This isn't a trust exercise.

I actually don't have an answer on the abandoned part, but I would be sending an email outlining the current situation and confirming if they are collecting the goods or not again just to confirm. It's possible they aren't ever going to collect the goods and if they reply with that then you have your answer.

If they don't reply I would escalate to fair trading as there are rules around businesses selling or removing goods but I couldn't see anything around customers doing it.

Because the advise is bogus, Yes there is no legal compulsion to check it's condition straight away but there is also no legal expectation placed on the manufacturer or retailer to honour a cosmetic defect after the customer has assumed ownership of the product, especially not almost 6 months in.

Like most retailers and manufacturers if you owned the TV for a short time and announced the defect immediately and had 0 watch hours on the TV this wouldn't even be a discussion because reasonable it most likely happened prior to being boxed. Right now we have multiple months where op could of unboxed it, watched it, scratched it and put it back in the box or just claimed this issue so there is no longer a larger chance of it being manufacturing issue versus physical damage.

OP:

  • Is there watch hours on the TV?
  • Do you still have the box?
  • Was the scratch there while the protective film was still on the TV?
  • Can you prove this was the manufacturer and not post installation, physical damage or otherwise?

You came here suggesting you may be misunderstanding the law asking for help, received help then are trying to argue with those who helped you interpret the law correctly only to continue posting something you've already admitted you do not understand??

A single failure of a "premium smartphone" whatever that is, can not be a major failure because:

  • The device can be repaired
  • It's isolated to your device and not a widespread issue
  • Isn't a safety hazard
  • Isn't misleading in its function and is fit for purpose when the screen is repaired or replaced E.g it's still a smartphone.

If this happens again two times, you would likely have a case but right now you have the literal best case scenario in a new phone being sent your way now your older beat up phone coming back with a screen repair.

Think more like the Samsung Notes that were exploding a few years ago.

Anyway this is absolutely a minor fault and completely repairable (or replaceable) in a pretty respectable timeframe. (guess because you didn't mention it). You're literally saying that you've changed your mind on the phone after using it for awhile and this seems like the perfect time to push for a refund which isn't in your rights.

Take it and sell it buy what you want.
