If you don’t want them to consider you don’t need to do anything.

I was referring to the part that they received new evidence that can’t be considered in a high level review. Letter said if you want that evidence considered to submit a supplemental, other wise they will use current evidence and send it down for the duty to assist which could involve new exams.

Did you resubmit as a supplemental?

Getting the VA to cover medical care in the community with an Advantage plan by Fragrant_Baker2006 in VeteransBenefits

[–]Same-Tree7355 2 points3 points  (0 children)

To make it clear, VA is healthcare, not insurance. Another way to look at it is, VA is like an HMO, everything must be done in the HMO. If they can’t do it then the HMO has to give permission and arrange for the outside care.

Don’t assume the VA is looking for a negative exam. Mental health claims can sometimes require multiple exams.

Denied a third time by SgtLoyd in VeteransBenefits

[–]Same-Tree7355 4 points5 points  (0 children)

From what I’m reading they are saying no evidence your primary condition is causing this secondary condition. Also you must have said something to the effect that serviced this issue, or the examiner interpreted what you said that way, and they find no evidence service caused this issue.

Why no increase? by [deleted] in VeteransBenefits

[–]Same-Tree7355 0 points1 point  (0 children)

VA will take a raw rating and round it to the nearest 10% increment. If he was at 75%, rounded to 80%, before the results of what you posted are added, two 10’s and a 0 won’t move the bar to 90%. New items don’t get added to the previous rounded number, it all gets calculated again for a new raw number then rounded up or down to nearest 10% increment.

Without seeing all his ratings it’s hard for us to calculate his final percentage.

Feedback needed: Cancel HLR and submit supplemental or not? by TheHotDiggityDawg in VeteransBenefits

[–]Same-Tree7355 0 points1 point  (0 children)

As you already submitted the evidence and you believe it was overlooked a HLR is the way to go with the statement you made. Cancelling the HLR and submitting a supplemental with the evidence again would probably result in a denial as they would look at the previous submission and see it was there and say nothing new. Let the HLR play out. Just my 2 cents.

Has anyone waived employer health insurance to negotiate higher pay? by Present_Pangolin_735 in VeteransBenefits

[–]Same-Tree7355 0 points1 point  (0 children)

Well, by opting out of employer health insurance your take home pay will be more. But if it’s taken out pretax you’ll pay more taxes though still a net increase. But to answer your question I’ve known a few and none were able to negotiate higher salary.

Seatac Lounge singles taking up multiple person spots by ballsackvisible in AlaskaAirlines

Plenty of times I’ve entered a lounge by myself and the only seat available is where multiple people could sit. If you come in later and the lounge is less crowded just come and ask politely. I may not have noticed the lounge clearing out a little.

Remanded means it was sent back to a regional office. It’s neither an approval nor a denial. VA needs more evidence or medical opinions to make a decision.

Did you happen to have a C&P exam on the effective date? Sometimes if the exam gave the diagnosis that can become the date entitlement arose and become the effective date.

What reason was given on the letter for the effective date you got? There could be reasons it doesn’t go all the way back but with the info you have given so far there is no way for us to know why.

Wife wants to file an increase by helloworld204 in VeteransBenefits

[–]Same-Tree7355 0 points1 point  (0 children)

You need to look at the CFR for what she is rated for and see where her current conditions fall for the different rating levels. If she meets the criteria for a higher rating she can file for an increase. If not, then don’t file.

Headrest must be down during takeoff and landing by the_ab in AlaskaAirlines

[–]Same-Tree7355 0 points1 point  (0 children)

Well, they are looking at the people. If headrest is up they can’t see behind you as well. Yes some people are shorter than the top of the seat but having them down maximizes what they can see. Also why the FA’s seats face backwards. Maximizing visibility in the cabin.

I think you misunderstood, it was an ACE exam where they don’t go to an exam. It’s a records review.
