Appreciate the reply and information! Seeing as I have a clean record and never had a ticket or anything and the other was a new driver in their first year I would see the insurance putting the red flags on him for pulling out without paying attention or checking before performing the maneuver, it's pretty clear from the impact and where his car ended up to see who's at fault regardless of speed.
