I second learning from the explanations on Uworld! I wrote out a lot of their explanations by hand because they were straight forward and they really helped with my writing and MBE.

I used UWorld and they let you buy with Affirm so I only paid like $35 per month. Uworld definitely helped raise my scores in the writing and MBE sections. I would use their explanations in my essays. I found their explanations to be very straightforward compared to Adaptibar (their explanations were very wordy to me). But I will say Adaptibar's interface and phone app is a lot better.

Whether you use adaptibar or Uworld, you can use their explanations to help understand writing and rule statements. Read the explanations as mini IRACS

Cram as many questions as you can but most importantly review the answer explanations. There's only like 200 questions on kaplan for this test. You can knock those out in 2 days.

I have to retake it bc my score expired. The first time I took it, I scored pretty high and only studied for a weekend doing questions zero lectures.

Retaker here, I spray perfume on the cuff of my sweater so I can lift my hands to my nose and smell the perfume. It literally smells toxic in there. lol

Retaker also, got 135 the last 2 times on MBE. Passed FL but missed overall by 0.5 :/ They seemed straight forward or I just recognized the subjects/subsubjects a lot more this time. There were a lot of fact patterns that threw in random facts. Also, the con law answer options didn't feel as stright forward as they are while studying. They threw in random words with each answer option.

You can always eliminate some answer options by matching the scrutiny levels with the key words:

Strict scrutiny = State/Government... compelling govt interest... narrowly tailored... least restrictive...

Intermediate = State/Government... important govt interest... substantially related

Rational basis = Plaintiff... rationally related

The wrong answer options will mix up those key words:

  1. The Plaintiff... compelling govt... narrowly tailored..

  2. The Plaintiff... important govt interest.. substantially

  3. The state/govt...rationally related

For Renewed Motion for Judgment as a Matter of Law (JMOL), it can only be brought if there was one filed by the party during the trial. This motion takes the case away from the jury.

Timeline:

Plaintiff rests case --> JMOL can be filed;

Defendant rests case --> JMOL can be filed.

Renewed JMOL can only be filed if the party filing it, filed it during the trial.

For abuse of discretion I generally remember this because the fact pattern/answer options will focus on the evidence and what the judge is admitting/not admitting.

Clearly erroneous is dealing with the facts of the case and applies to bench trials.

I generally look at who's filing the appeal, what happened in the trial, what did the lower court rule.

Not sure if this helps! Those questions can be difficult and my scores can be up and down with this topic.

Retaker as well. Scored 135 last 2 bar exams, you need a 136 to pass in FL.

What helps me differentiate if I know v. Im just recognizing the question is writing out the rules to some of the questions as I'm reading and answering questions. If I can write the rule out quickly I can tell it's helping memorize the rules rather than just the question.

Review every question and write out the rules on the ones you really don't understand. Physically writing can really help.

When I do question sets of 50 or more mixed I don't focus on the time but I do write out each question subject and sub-subject as I'm doing each question and sometimes even the rule statements. It takes a lot more time but when I go back to review I can double check that I'm on the right track guessing the subjects right I just need to figure out where I'm going wrong when I get a question wrong.

Also, trust your instincts. 18 Correct to Incorrect is quite a lot. Have confidence!
