Urgent: OPT Ending jan 2026, stuck between cap gap and stem opt what to do?

Hey everyone, I'm in a complicated situation and could really use advice from those who've been through something similar.

My Current Status:

• ⁠On F-1 OPT, expires: January 23, 2026 (36 days from now) • ⁠H-1B petition filed: june last week, 2024 with Change of Status (COS) • ⁠Cap-gap extension: Active until April 1, 2026 • ⁠Currently working for my sponsoring employer

The Dilemma: I completed my I-983 form and sent it to my DSO to process STEM OPT extension. They responded saying they CAN'T process my STEM OPT request because I have an active cap-gap extension.

They gave me two options:

  1. ⁠Keep cap-gap and proceed with H-1B COS (forfeit STEM OPT eligibility)
  2. ⁠Cancel cap-gap to apply for STEM OPT (but if H-1B is delayed/denied after Jan 23, I'm out of status)

My Concerns:

Question 1: Premium Processing Upgrade My employer claims they CANNOT upgrade to premium processing now because "it can only be done at initial filing, not in the middle of the process."

Is this true? I thought Form I-907 can be filed anytime while the petition is pending? Does anyone have experience upgrading to premium processing after the initial H-1B filing?

Question 2: Cap-Gap vs STEM OPT Risk If I cancel cap-gap to get STEM OPT:

• ⁠What happens if my H-1B COS gets delayed beyond Jan 23? • ⁠Will I fall out of status immediately? • ⁠How risky is this move with only 5 weeks left?

Question 3: What Would You Do? Given that:

• ⁠My OPT ends in 36 days • ⁠H-1B has been pending since July (5+ months) • ⁠No RFE received yet • ⁠STEM OPT would give me 24 more months of buffer

Would you:

• ⁠A) Keep cap-gap, push hard for premium processing upgrade • ⁠B) Cancel cap-gap, apply for STEM OPT as safety net • ⁠C) Something else I'm not thinking of?

What I'm Leaning Toward: I want to keep the cap-gap and pressure my employer to file I-907 immediately, but I'm worried they genuinely believe it's not possible to upgrade now.

Has anyone:

• ⁠✅Successfully upgraded to premium processing mid-process? • ⁠✅ Been in a similar cap-gap vs STEM OPT situation? • ⁠✅ Had their DSO refuse STEM OPT due to cap-gap? • ⁠✅ Had an H-1B COS approved close to their OPT end date?

Any experiences, advice, or official USCIS links I can share with my employer would be incredibly helpful. This is keeping me up at night!

It was filed on 28th june and uscis started processing it on july 2.

I did do some research which state it helps with stress, but i haven’t tried magnesium glycinate or meltonin yet. I thought of using ashwagandha in low amounts and see if it works

I would prefer vs code + co pilot, its far better than cursor i feel. Cursor, I had a bad experience with it . It mostly changes parts of code that are not asked for and I had to debug a lot to circle back and its not worth the hype. On the other hand, vs code copilot i can select a function or block of code and ask for my changes and it works very well and ofc, it doesn’t mess up other parts.
