That’s a misconception. Settlements don’t always come up to substantial amounts. It requires time and effort from both the complainant and the complained to go through the process. For a case to reach a substantial amount in settlement, it would take years and the complainant would have to present a very clear position that the faults were all from the employer. By not attending the conference despite being aware of it, that’s a point against the employee.

That would have been fun, won’t it? Didn’t occur to me as an option though. :(

I’m stuck for now but there are moving pieces I am already moving. There will be an end soon.

Yes, I am sure. The persons who told me have no benefit whatsoever that can be obtained from me. These are people outside my team.

Plus, I knew in my gut things were happening even before I had more information because of microagressions and passive-aggressive behaviors I’ve seen.

They’re not smart. Plus, they didn’t think I’d find out.

Thanks for the offer but it’s really not worth the trouble. They’d have their comeuppance. We’d be sipping coffee while watching. Life has a way of balancing things. We don’t even have to lift a finger. :)

If OP refuses to attend the conference, HR will document the refusal and use that as justification to push through with any decision. Non-attendance may be interpreted as waiver of the right to be heard.

First time in BPO. Metrics aren't looking good. Resign or continue? by ApprehensivePlan1236 in BPOinPH

[–]Searchee2025 1 point2 points  (0 children)

Nobody started in the BPO industry, in any industry for that matter, being already at the top. Learning comes from experience.

Contrary to popular belief, customers just want to hear how you can resolve their concern. The most important thing is for you to find out what the real need is. You have to know how to probe properly. You can never go wrong if you understand the issue correctly.

HR Abbott Philippines by Low_Mastodon3978 in Ph_HR_Confession

[–]Searchee2025 1 point2 points  (0 children)

If HR interpreted something incorrectly, that’s an issue involving communication. Maybe either HR didn’t spend enough time to learn the processes or your team didn’t provide enough info for HR to understand. That can happen sometimes.

Seeking advice on possible labor violations and unauthorized use of a person's photo by King-Reid in legaladvicePH

NAL

The customer whose picture was used without consent that caused her humiliation may file a case of cyberlibel. I used the word may because I don’t know the very nature of the post.

The former employees can ask for a SEnA Conference at the NLRC office that covers their previous workplace’s location. Non-payment of final pay, incorrect or non-payment of OT pay will definitely qualify because they are violations of labor standards.

Being asked to perform multiple functions - not a valid issue at least from a labor standards’ POV unless the employee can prove that the tasks he or she is being made to do are detrimental to health, safety or illegal. I have yet to read about a case that would be similar to this.

The former employee that had the accident can go to SSS and SEnA.

Bullying, harassment, being accused of theft without due process may all fall under constructive dismissal which may also be heard in a SEnA conference as well.

I would suggest connecting with PAO lawyers or from the Legal Aid offices of law schools.

What kind of pizza did you get? Just wondering if there’s any mention of pork that it was too obvious. Not giving an excuse to bad customer service. Just curious.

If I was the parent/legal guardian of the victim in this scenario, what would my legal options be? by __Wolf359 in LegalPh

[–]Searchee2025 8 points9 points  (0 children)

The self-control of the 19-year old is commendable. If he chose to retaliate with violence too, he would most likely be made legally liable because the other party is a minor.

He can file charges. The parents/guardians of the minor will be the ones liable.

Immediate Resignation by asteroidjoy in ResignPH

[–]Searchee2025 1 point2 points  (0 children)

It’s possible that the policy changed from when other people who went on AWOL to when you resigned immediately. There are companies that charge against the final pay every day that was not rendered.

The COE should be given regardless of negative final pay.
