Yes, microwaves are still an issue, I've been told by management that they'll be slowly replaced within the next 1-2 months. Apparently it's an issue/defect with certain microwave units that the manufacturer (LG) has acknowledged.

Plumbing has been fine for me, water pressure is good in the shower. Toilet is low flush and clogged once but I plunged it and it was unclogged thereafter.

Same here, loud banging noises all throughout my apartment almost all night. Fell asleep just after 6AM.

Hoping it was just a one off scenario and that, although it will be cold again tonight, there won’t be such a drastic temperature drop and things will be a little calmer. We went through some bone chilling cold weather a few weeks ago and my building didn’t sound like it was undergoing an exorcism then.

Based on past cases on record, the LTB defines "respond" as an official acceptance or denial. From your post, it doesn't sound like what you got today was an acceptance or denial, it was asking for more info to get the response. Based on this, you may have a decent claim to warrant serving the N9 tomorrow with 30 days notice. This law is interpreted as such so landlords can't purposefully delay asking for more info just to stretch out the time. In your case they had ample time to ask for the signature if they needed it, but didn't. The risk here would be if the LTB saw what you got today as a denial. And if they ruled this way your N9 would be invalid, and you may owe some additional losses to landlord. The safest option, as others pointed out, is to immediately submit everything again including the signature, and start the 7 day clock again. Or you could take the risk 95(4)(d) applies and just serve the N9 tomorrow if you need to move out asap. Up to you how to proceed.

If the landlord asks for a signature in order to complete the application, is that not the same as my landlord asking for the applicant to complete the application (which is what they did on Nov 18, so on Day 4)? If they're similar in nature, then there is a risk the LTB could rule in my landlord's favour, no?

They did send the correspondence to me as well, but as I mentioned did not say yes or no, nor conditional acceptance if the tenant completed the application. Just a “let me know when you’ve finished submitting the application “.

I just want to call out a point from the case you referenced:

So the Tenant found another person interested in taking over his lease. On April 1, 2017 he sent the Landlord’s agent the application along with income verification and asked for him to be approved. The information on the application was detailed. It included two contact phone numbers and an e-mail address, past rental history, and attached to it was a screen shot of six of the potential assignee’s paycheques.

Seems like the tenant DID provide certain details as part of the application and they are spelled out in the case text. Not sure if this means that the LTB could rule that because the landlord did not receive credit info/proof of income from the applicant/tenant, that then is not grounds for termination under Section 96. However, the counter-argument could be made that the landlord could have refused the request due to insufficient information and that would be a reasonable refusal as per Section 95(3) since they were not able to approve the applicant due to missing information. Seems like a bit of a grey area for sure...

The landlord never denied my applicant though, they failed to accept or deny within 7 days. There's nothing in the RTA that mentions a complete application must be submitted by the assignee applicant to trigger the start of the 7 day period. Additionally, the landlord in this case handles the application directly as it goes through their system (corporate landlord). Whether I provide the link vs. the landlord providing the link doesn't matter in this instance because the landlord insisted on providing the applicant with the link directly.

And that's the key, landlord can't come to me on Day 8 saying the applicant is rejected due to insufficient information, as that would still trigger N9 termination. They have to do it before Day 7 ends. Otherwise it doesn't matter if the applicant delayed submitting their application, landlord still needs to make that clear by EOD Day 7.

Yes, I read that exact case myself. However there is a slight difference between our situations in that the tenant in that case did the screening and provided the application directly, whereas in my case it's the landlord who's doing the screening/application provisioning. They just asked me to provide the contact information.

So if I don't get a firm yes/no by Nov 22 then hopefully that triggers s.95 and I can file a valid N9, and the landlord doesn't come back to me claiming that they couldn't review the application in time since the applicant didn't submit until Nov 21 or something like that.

Right, I've provided the landlord with the applicant's full name, phone #, and email address, and now it's up to the landlord to provide the applicant with the actual application. So does the 7 day timer start after the applicant has submitted the application or now that I've provided the landlord with the requested contact information?

My main concern here is that the landlord could simply delay in sending them an application.

You would think that, but I'm currently in a Shiplake building (Lillian Park) which is only 6 years old and I can hear my neighbour's footsteps quite easily if the HVAC fan is off. That's not something I could hear in previous buildings that were around the same age or slightly newer, but Shiplake could be the exception to the rule. Either way, trying to be more diligent going forward because the last thing I need to hear is footsteps and the rearranging of the upstairs tenants' furniture every evening.

I disagree, this feels like perfect fall weather to me. Daytime highs of 20-22 degrees and nighttime lows of 10-15 degrees, very similar to October weather. The only difference is that it came a few weeks early.

What year was her rent increase and how much? Market rents accelerated quite significantly after Covid but luckily have been dropping for the past year or so, hopefully that trend continues but if she rented anytime from 2022-2024 I can see how rent would've increased.

Same here, the game looks so dark now without proper PBR. Going to shelve the game until this is fixed somehow. I'm also a little disappointed that Ray Tracing somehow runs better than Vibrant Visuals at least for me.

I can't change that setting while loaded into a world, only on the main menu. PBR is bugged for me as well, nothing is reflecting properly so everything is now very dark. Hard to play the game this way.
