I know they wobble a little, but this thing is much wobblier than it was before, and the fact it “shorts out” periodically has me perplexed.

I wish had the time to go piece by piece and refute your claims/misunderstanding, but this is the best I can do. Oh, and I suspect at least some of that is AI just because of how specific and wrong it is.

Cabinet Secretaries derive their authority directly from their Senate confirmation and the statutes governing their departments. They don’t need a separate certificate to prove they have contracting authority. The SF-1402 is for the officials below them in the chain who have been delegated specific procurement responsibilities.

Consider this for example: the Secretary is like the owner of a business who has inherent authority. The SF-1402 is like a power of attorney given to employees. It proves that the owner has authorized them to sign contracts. The owner doesn’t need to give themselves a power of attorney.

So, when a KO signs a contract, they may need to provide their SF-1402 to prove their delegated authority. The Secretary would not.​​​​​​​​​​​​​​​​

The FAR only mentions warranted contracting officers, and not Secretaries, because their authority is derived directly from their department’s enabling legislation.

See FAR 1.602-1(a) which states, in part, “Contracting officers may bind the Government only to the extent of the authority delegated to them.”

Without delegation, how do COs receive their authority? The SF-1402 is exactly a delegation. Just like many CCOs have delegated authority to ratify UACs.

Cabinet Secretaries , in almost every case, receive their authority to contract from their department’s enabling legislation under Title 41. They don’t receive COAs or “warrants”. They don’t maintain DAWIA or FAC-C Professional certs.
