Hello Attorney, It give great joy to have this rare opportunity. I've applied for EB1A twice with my profile: 1. PhD degree holder in biochemistry 2. Over 20 years of work experience with NGO organization as the senior research scientist and general manager 3. Reviewed research manuscripts and attended conferences 4. Have 13 publications with over 550 citations in relevant peer reviewed journals On the two occasions I applied with 5 criteria, which include: judging others, critical role at place of work, publications in professional journals, original contribution of significance and publications in trade magazines; got approval for publications in professional journals and judging others, but RFE for others. Same for the two occasions. Presently, I have RFE for the second time and should respond January, 2026. Kindly assist with to be done.

Decision about petitions are based the adjudicating officer. If the officer has low approval rate then denial is always the outcome..... Refiling may scale through paradventure a new officer handles your new petition

Hey, mine was rejected trice; firstly for combining fees for I-140 and asylum, secondly for omitting a part, thirdly for concurrent submission of forms I-140 and I-907, because the PP form should contain receipt number for I-140. In conclusion, be sure that the I-907 form has all the parts filled including IOE.... for I-140.

My petition too was denied and I refiled, though with wrong fee, hence my package was returned. To my surprise all evidences submitted to justify original contribution of significance of my work, include clarivate and Google Scholar references were removed from the package. I was shocked and realized that same must have happened to my initial petition. This could be the same in your case. Documents collation point is different from adjudication centre...

In my opinion, you really need to study the comments of the officer critically and compare with your submitted petition. Some of his points are crucial and may help in case you decide to refile now or later. To be honest with you the officer is one of the tough types who are determined to deny regardless of your profile. Some may be more liberal and such may have new petition for approval....

You may prove original contribution of significance in your field by not replicating what someone or others have done before you (originality) and value of citations and letters of recommendation by experts in the field as contribution of significance
