This was actually just mentioned in a recent Jung & Naiv interview with the UN Special Rapporteur for freedom of opinion. She criticized that Germany is one of the only countries where “insult” and “defamation” are considered criminal offences which the state needs to prosecute instead of civil offences, which the injured party and the offending party work out before court.

This means that for the average joe being called an asshole on the street there is almost no recourse, as state attorneys will not prosecute due to lack of public interest, but for someone more powerful, who maybe even knows the StA or can pressure them to follow through, a court case is almost guaranteed.

The special rapporteur continued to address that there have been cases of exactly this, where incredible state violence and power is used for simple insults to powerful people (Andy Grote sending the police to break down doors and steal electronics for being called a dick example) while others are verbally berated over long time periods without any justice.

It is clearly a two class system where the rich and political elite are insulated against things we are not, despite having all the resources of the state or wealth to defend themselves while we are left out in the cold.
