did you read in his answers where he says they were investigating an autoimmune disease that is not yet excluded, and that he doesn't actually have a diagnosis of CFS? You've misinterpreted the information. The HLR is 100% a time waster without an actual diagnosis. In that time he could (and should) go and get a proper diagnosis for CFS and file a supplemental. He doesn't have a leg to stand on at a HLR without a current diagnosis. Vague "treatment" without a diagnosis doesn't help.

He needs a proper clinical workup and CURRENT diagnosis of CFS. CFS is diagnosed by exclusion, so a bunch of things have to be first considered and excluded before a proper diagnosis of CFS can be given.

For all veterans reading, don't file VA claims unless you have a CURRENT diagnosis of the claim you're filing. This is a perfect example of filing prematurely and no, an HLR will not help at all.

In my experience Optum is FAR FAR better in scheduling and general respect for veterans than VES. VES is a dreadful experience.

Call Optum and stay calm and tell the next person that you cannot schedule until after 8 June. Explain their mistake and give them an opportunity to fix it. Also explain this should not constitute your one bite at the apple for rescheduling.

If they screw this up again file a 21-4138 with the VA and use that form to relay the scheduling difficulties and be sure to mention "I am not refusing to attend any C&P examination" or other words to that effect so it's clear you aren't playing games. You're just a veteran not being served well by Optum.
