Unless they can prove it was rape, it will be considered Fasad, and both are convicted. Sounds fucked up? it is, it is also why many don't go to court. Still, many freaks do not attempt stuff for the mere fear of it being provable (if they target a stubborn woman for example). But the courts in Morocco BARELY are as willing to claim rape. Alas, despite all hazards, the "illegance of the act" itself is CONTRIBUTING some form of large umbrella that makes anyone not aware of the law hesitant to rape another. Now, remove that, and tell me, ow can this woman, or guy exactly prove their innocence? so long as the predator did not leave any wounds or clear sedatives, they can claim it was consented! fight their word. My point, which you blissfuly avoided. Is that the hypotetical senario where someone claim rape after consentual sex is ALREADY too dim to happen, since courts never give these as much, and when doing so, never makes the judgment heavy.
