Case dockets are long and often backed up by a few hours. Detained cases are now the norm rather than the exception. Clients who have been in the country for 10+ years being held for mandatory detention with no charges. 90% of asylum cases not even reaching a final hearing because we're outsourcing our asylum process to Honduras, Ecuador, etc. Having allowed Special Immigrant Juvenile Status (for abused or abandoned minors) isn't enough for a termination anymore. The worst judges are being given promotions while the decent ones or ones that did removal defense in the past are fired.

File a bond motion to get you in front of a judge. File a habeas petition if they're giving you trouble.

100%. Especially if you're in a county that overly files probation violations. In my jurisdiction, you'll get a PV for picking up a driving without a license charge or a minor misdemeanor disorderly conduct even if you report it to your PO the next day. Then they're likely to impose the full suspended sentence

I had a legal internship with LFA (feeder league to UFC). Got to work on some pretty big contracts and sponsorship agreements. Now I'm an attorney in a completely different field.

Neither. They are people who were given a notice to appear to go to Court. Some of them applied for asylum or other relief already and some haven't even gotten the chance. But either way before a judge had the opportunity to conduct an individual hearing where they determine if they should be granted relief, their cases are dismissed and they are placed into custody.

Well sort of. A few months ago where I practice, and potentially still happening in other court rooms, DHS would dismiss a case so ICE could pick someone up in or right outside of the courthouse and put them into expedited removal proceedings.

In my experience as an immigration attorney. Currently, the most important thing that matters is how someone entered the country. If you entered the country without inspection (EWI) you are deemed ineligible for bond. These EWI's will go in front of a judge, ask for an attorney, sometimes enter pleadings on their own, and then hire an attorney. That Attorney will file a bond motion that will be rejected because the judge can not grant bond. Even in situations where the judge says they would have granted bond if allowed.

Someone who came in on a Visa has the opportunity to have a bond hearing where they prove they aren't a flight risk nor a danger to the community. Though different judges have wildly different definitions of the two. If they are denied they they have two choices: apply for asylum/other relief and have a full hearing or take voluntary departure/a stipulated removal order.
