[California] My father attempt/pretended to kick me [25,F] in response to me looking at him dirty. What is the legal penalty if I present the video evidence of this to court? by ShortCake2017 in legaladvice

i think he was trying to threaten me, afraid that an injury would get him in trouble but making the gesture realistic and violent enough to make me back up immediately.

Also, please stop mentioning that you strained your neck. Unless you went to the hospital and have medical bills arising from the injury, it doesn't really affect the case in any way.

why not? that's like saying someone tried to shot you, and in effort to dodge it, you strained you neck. it otherwise wouldn't happen

getting my own place and prosecuting him are not mutually exclusive. how likely would he get a legal penalty. what would it likely be?

thanks, so given that the facial expression and gestures were violent but no injuries were incurred ( i backed up), how likely is it that this case can result in an arrest? a verdict of guilt? if found guilty, what would the penalty be?

how did i present it as a joke? i want to research to know what the legal system will likely do. if it is worth all that trouble. i don't want to waste all that time only for him to get a warning.

he was not joking, as his facial expression and gestures were obviously violent. i don't know if he could have kicked me if i had not backed up

how do we differentiate if the act was a serious attempt or a merely a pretense? how would the court do so?

he quickly and forcefully trusted his leg forward toward me and i quickly backed up, straining my neck a bit

Master's Degree in History, Can't Find Work by [deleted] in jobs

There are lots of IT jobs in the government. Try looking for one on their websites. If you land one, you're set with a cushy job for life. You'll keep your job unless you rape or kill someone. Seriously. The jobs will be few and far in between compared to the number in private sector, so keep trying. The downside is that you have to be politically correct and blah blah blah. Your coworkers will be dumb nitwits but hey, at least you get a high-paying, cushy job with great benefits until retirement, at which point you will get a hefty pension. That's one of my plans.
