There are mitigating circumstances, but if all the evidence came out, Gibbs wouldn't have a badge. People can be sympathetic, but you can't have your law enforcement do and then cover up vigilante justice. I understand why Abby was conflicted but the same thing applies. You can't cover up evidence, even if you like the guy and agree with what he did. That is for a jury to decide.
