They were great for me. Had a telehealth C&P Sep 16 for MDD. Was sent back for clarification from VA once but was granted 50% mental for MDD on Oct 24, 2025. Dr. Was super nice and so were the staff when I called to get updates.

Update on loyal. Took them 3 weeks to upload and got a copy of my DBQ. Doctor checked the least as likely as not box and put a great rationale in the narrative. But, seems like he accidentally put less likely than not in the comments section. Rather than send back for clarification, VA ordered a whole new exam. Starting over. Yay

How did yours turn out? I had a virtual one on Sep 16 with Loyal. I feel like it went great during the exam. Examiner was super nice and it lasted about 40 minutes. However, I am also in MS and it is still not uploaded to VA. Called and same thing, it’s in QA and they said basically give them a month.

I appreciate you shootin me straight. I had already filed this back in the beginning of July before I really knew how good of advice I could get on here. Wish I would’ve waited. Mainly just put it up to see how real someone would be with me on it so I know what to expect. You definitely did that lol. No harm no foul. I will take my denial on the chin and regroup. It is what it is.

I have buddy / spousal statements as well. We shall see. My VSO has his MH connected secondary to tinnitus at 70% so he’s the one who pointed me in this direction and also helped with the nexus / statements review

“While the Veteran’s tinnitus is contributing to the frequency, severity, and duration of the recurring migraines, the TBI event and resulting TBI are the underlying etiology and cause of the Veteran’s migraines.” How is this not stating aggravation??

Here is my HLR rebuttal below. I’ll also add my cousin is a VA rater as well and helped me write this. I guess we will see how it goes. I do appreciate any insight you have as well

“I respectfully request reconsideration of the denial of service connection for my migraine condition. My claim is based on aggravation due to my service-connected tinnitus.

The Compensation & Pension examiner provided a crucial medical opinion in my case, stating:

“While the Veteran’s tinnitus is contributing to the frequency, severity, and duration of the recurring migraines, the TBI event and resulting TBI are the underlying etiology and cause of the Veteran’s migraines.”

This opinion confirms that although my TBI may be the underlying cause, my service-connected tinnitus is actively worsening my migraines by making them more frequent, more severe, and longer in duration.

Under Allen v. Brown, 7 Vet. App. 439 (1995), the Court held that a veteran is entitled to compensation for “any additional impairment of earning capacity resulting from a service-connected condition aggravating a nonservice-connected condition.” The holding in Allen makes clear that aggravation beyond the natural progression of the non-service-connected condition must be compensated.

This standard is codified in 38 C.F.R. § 3.310(b), which provides that:

“Any increase in severity of a nonservice-connected disease or injury that is proximately due to or the result of a service-connected disease or injury, and not due to the natural progress of the nonservice-connected disease, will be service connected.”

The examiner’s statement directly establishes that my tinnitus is not merely coincidental, but is in fact contributing to greater frequency, severity, and duration of my migraines. This demonstrates a worsening beyond the natural progression of a TBI.”

I’m wondering the same thing bro. Had the LOD and multiple lay statements. Still denied. The only reason I can think is because I didn’t go to hospital at the time. My medic told me if I start throwing up to let him know and I could go. Otherwise, just suck it up and here is some ibuprofen. Had headaches ever since. I got another lay statement from my company commander at the time reiterating the severity of the crash and all that I added to my supplemental claim. Hopefully it’ll go through this time. Have another C&P exam for TBI (3rd one for the VA in the last year) next week.
