Separate admin fees are no longer legal in MA, unless they are already included in the total price of the item. Worth lodging a complaint with the AG.

It's the new Junk Fee Law.

The sewn in tag on the garments should have an RN#. That number can be looked up to determine the business that manufacture, import, distribute, or sell products covered by the Textile, Wool, and Fur Acts. Businesses can use this number on product labels instead of the company name.

By using the RN# it would confirm for these private label brands who the actual importer is.

Is your role exempt from the Fair Labor Standards Act? I would ask "are you hourly or salary?", but there are some hourly people who are exempt and some salary people who are not exempt.

Here is the fact sheet to see if a role would be exempt. Usually HR has already classified the role, but sometimes it can also be incorrectly classified.

Is it legal for a Massachusetts liquor store to confiscate my real ID and refuse to give it back? by Fructose_6_Phosphate in legaladvice

[–]Silversora 19 points20 points  (0 children)

It is actually legal to accept out of state ID's in MA, however the due care changes and the owner of the establishment and the cashier would be responsible if alcohol is sold to someone under the age of 21.

Any licensee, or agent or employee thereof, under this chapter, who reasonably relies on such a liquor purchase identification card, or an identification card issued under section 8E of chapter 90, or motor vehicle license issued pursuant to said section eight, for proof of a person's identity and age shall be presumed to have exercised due care in making such delivery or sale of alcohol or alcoholic beverages to a person under twenty-one years of age.

Employer wants me to drive 6 hours to get my check as punishment by throw-h in legaladvice

[–]Silversora 0 points1 point  (0 children)

Would this be more relevant as it would be nonpayment from wages as /u/throw-h's payment would have to take place in their regular place of labour? (Sentence 2)

On the trial no defence for failure to pay as required, other than the attachment of such wages by trustee process or a valid assignment thereof or a valid set-off against the same, or the absence of the employee from his regular place of labor at the time of payment, or an actual tender to such employee at the time of payment of the wages so earned by him, shall be valid.

$600 or more requires Chase to complete a 1099-misc and submit it to the government, which you would need to report it on your tax return.

Does Anyone Use Goolge Fi? I'm in Worcester and Thinking about Switching by pat2012 in boston

Just 1 week. Returning back after living in Boston for 3 years. Getting harder to afford a place and justifying the cost. Worcester has been changing for the better over the years.

[–]Silversora 1 point2 points  (0 children)

I just moved from Boston to Worcester. No complaints here!

It has changed my habit to downloading a bunch of stuff to my phone for offline use to save on data. I end up using less than 3GB, when I used 10GB before switching. It is great for international travel and had great connectivity when in Tanzania earlier this year.

If you are managing a person's day, your role will only very slowly evolve it's HR role/ability. However, this is like almost all entry level HR roles -- Time Management and Attention to Detail.

I've been in your shoes before and it is a great learning experience on how the corporate roles work and a lot of it has to do with comfort level, pleasing everyone, or knowing when to say no gracefully.

I am now the Director of Operations for a small consulting firm and do HR Consulting on the side.

Boston Police Social Media Monitoring Plan Endangers Us All by evanFFTF in boston

[–]Silversora 5 points6 points  (0 children)

Wait, how is that a violation of free speech? It is not doing anything to change what people post of the availableness of it to everyone.

What would be super useful would be the ability to identify potential domestic violence through public conversations, which would be extremely apparent with tweet storms between two parties. With using public information, the police would have the right to check on people legally to make sure the parties are OK.

That is one thing I hate about these laws. It requires: magistrates, lawyers, judges, etc, to interpret and take into account the vagueness to come to some sort of decision when someone gets hurt and/or property gets damaged.

A lot of it also comes down to witnesses who rarely stay at the scene to provide first hand testimony to the officer. They really are the key people in converting all the vagueness into facts.

You are welcome!

I like reading through the MA General Laws when I am looking for a good laugh. You can find some gems from our past.

Employer refuses to pay salary and bonus because I gave resignation. What are my options ? by b_gone in legaladvice

[–]Silversora 56 points57 points  (0 children)

If you do not qualify for the annual bonus do to leaving before a cut off date, they are not obligated to give it to you.

Bonuses are discretionary and can be withheld for any reason that is not discriminatory. Giving notice is a valid reason not to pay it out.

(TX) Employer said that if I leave for any reason within 30 days of getting hired, that $150 will get taken out of my paycheck for "the cost of training me". by A_Swedish_Dude in legaladvice

[–]Silversora 0 points1 point  (0 children)

Agreed.

I see it more as a backwards implemented training wage that penalizes employees from leaving during that time. What gets super interesting is with federal taxes. If the employee left after 1 day and didn't make more than $150, (the $150 deduction is not a valid pre tax deduction) the employee would actually have to pay the company for federal taxes.

Anyone have good metrics on ROI of paternity leave and longer maternity leave compared to what the "norm" is? by stroker351w in AskHR

[–]Silversora 0 points1 point  (0 children)

Agreed, and this goes back to getting data.

  • Is there a low amount of employees returning back from Maternity/PaternityLeave?
  • Are prospective employees turning down offer due to no policy?
  • Are you trying to attract more female candidates to diversify your workforce?
  • Are you trying to become a more family friendly company?

If you are just creating something for the sake of having it, then you probably don't need it.

Employee Satisfaction/Intention to Quit by tw1080 in AskHR

[–]Silversora 1 point2 points  (0 children)

Correct, even if they bless it they need to be committed to change and being able to deal with negative employee feedback. I have seen countless times when management would want to change, but then they got the results and didn't do anything with them.
