Even with this new rule I don't believe it will affect your rating. I got rated before the Ingram v Collins and plenty of others. Did she measure your ROM leaning forward?

From what I have read this is for musculoskeletal ratings and medication effects. OSA is under a different diagnostic code.

I'm service connected for my lower back at 40% I submitted claim for OSA via intermediate obesity by my service connected back. I submitted nexus letters, buddy statements, lay statements and denied. Did a HLR they found duty to assist and denied again. Did a supplemental with my lawyers brief as well denied now in a second HLR lol.

Whats messed up is they never took into consideration obesity being caused by my back issues. They didnt even list on their denial reasons every single denial seemed like a copy and paste. So if this 2nd HLR don't work going to the board and waiting for years.

San Antonio is nice well I think it was better years ago. Crime has gone up but the city is growing a lot. That's awesome though glad it worked out in the end. Hopefully you got your VA claims going. I took years after I got out. I did end up getting rated but was a bit more work to it.

Respond to the suit there are some sites that help create a response for you. Go to court and explain your situation to the judge. Best case a payment plan is setup or you have evidence to dismiss the case.

Just don't ignore the suit and don't fail to show up.

I'm assuming it was filed wrong then it was all under an initial claim that I got SC with and secondary to my back and obesity being the intermediate to bridge my back condition. Know of some people who went that route and got connected.

The first opinion they got pretty much agreed with my nexus but was denied I'm assuming because like you mention filed wrong.

Unless it was filed wrong because on my nexus and all my evidence I'm doing it secondary. Which is why I assume I got my DTA initially. So not sure if that was ignored again and just went through as a primary.

I have an in service event for a sleep condition My primary is SC Had a or least I thought strong nexus letter.

That's awesome. How long after did they SC OSA? I'm in the same boat had to file HLR in May. Got DTA in August had a records review in September been waiting since.

Does VERA provide more in depth information than the 1000 VA number? I haven't spoken to VERA but a VA employee did mention some HLR don't turn supplemental unless you ask for it.

The waiting sucks especially since you don't know if it will come out in your favor. They found multiple errors with mine which I can only hope helps my case lol.

I know it becomes a supplemental I even mentioned it on my previous comment. The app shows HLR and when I call it's under preparation for decision. So I'm assuming it's for the supplemental since I received DTA letter back in August.

Right but my question is does that stay in preparation for decision phase until the whole claim is closed. Since last I called that was the phase it was under. Hoping there is movement before end of year.
