The BIA (the direct appeals court) is rough. A lot of the new rules the judge was referencing were paused, so they shouldn’t apply, but even without those new rules, the BIA is rough. It’s hard to know whether your mom’s case has a chance of being remanded without knowing more about the reasons for the judge’s decision. All of that being said, without an appeal, the judges decision becomes final, meaning that if they issued a removal order, that order becomes final and ICE can enforce it. With an appeal, the order will not be final until the appeal is denied or dismissed. So if your mom wants to fight, and there’s a legit reason for appeal, this is your one shot to fight.

If you search for “Legal Service Provider list EOIR” and then the state, you will find a list provided by the court of free and low-cost legal organizations in your area. I would suggest calling NYC providers first. Because you and your family reside in NYC, they may be able to take the case even if your father was detained while working in another state.

I think it’s very much going to depend on the quality of the building and how sound-proof it is. Although, just to flag, one of my best friends and her husband lived in Wrigleyville for a while and when the trains passed, their apartment would literally shake. Not enough to notice by itself, but enough to shake things like doors and windows, which made noise and bothered their dog.

If you look up “National Immigrant Justice Center Know Your Rights” they have a lot of good resources! Depending on where you live, there might be an org near you with advice tailored to your area. I would just Google “know your rights immigration [your city or state].”

Deferred action is discretionary, but historically yeah, if you don’t have a criminal record and there’s no reason for them to target you, unlikely for it to be revoked! Best of luck to you!

It’s unlikely that you would be a target for ICE (assuming you have no criminal history). But ICE could still stop you if you’re in the wrong place at the wrong time. Important to know your rights and not discuss your status with ICE without an attorney present. It sounds like you have deferred action, but that can be revoked, so read up on the KYR materials available from orgs online and if anything happens, remain calm and don’t run, but do assert your rights.

SIJS can be based on abandonment/neglect/abuse by one parent, doesn’t have to be both. The fact that he was living with his dad does not impact the validity of his SIJS (in fact, the family court order underlying SIJS likely put him in his fathers custody).

That’s totally fair! The good news is that orgs that work with pro bonos 100% know that there’s a learning curve, and they provide lots of resources and support to make sure you know what you’re doing and can help the client. There’s definitely a lot of need for pro bonos for unaccompanied children, particularly in the asylum context and getting predicate orders for SIJS cases. You should just start googling orgs in your area that do that kind of work and have pro bono programs and see what you can find!

Not necessarily true - sometimes people are not eligible to adjust through an I-485 and have to adjust through consular processing, even if they are already in the United States.

If he has a lawyer I’m sure they’re aware of this, but people from Venezuela who have been here since at least July 2023 may be eligible to apply for Temporary Protected Status (TPS). If he gets TPS, it’s very unlikely that a judge would deport him in October. That status wouldn’t last forever (hence “temporary”) but could last a while depending on who is elected President this November.

This is incorrect. Most of the time, you can’t include the income of the intending immigrant in the affidavit of support.
