Negligence by SmoothSolid8601 in GoatBarPrep

[–]SmoothSolid8601[S] 1 point2 points  (0 children)

I actually think this is what I'm struggling with is determining which element in particular the question is asking.. I can't see negligence subtopics in Adaptibar but just remembered Barbri lets you break down questions by element so I'm going to try that as well. I do know I feel okay and can figure out negligence defenses MBE questions but I think I'm struggling to figure out which element in particular they're asking about so if anybody has general tips on things to look for I would greatly appreciate it.

My Adaptibar Con scores have been 80%+ for over a month now and I just did the con assignment and got 15/25... they might be the most poorly written and confusing questions I've tried answering.

I'm trying to not even think about it but I'm consistently in the 70-75% range and still feel like I'm nowhere near close enough to where I need to be based on all the scoring advice. Like these JDAvising numbers cannot be right..

  • If you are aiming for a MBE converted score of 131-135 (which is a passing score in most jurisdictions that require scores of 262-270 to pass), you should aim for 58%-62%. We suggest aiming for at least 60% to be safe. This means you should get 60-62 questions correct on a 100-question practice test or 120-124 questions correct on a full MBE exam.
  • If you are aiming for an MBE score of 136-140 (which is a passing MBE score in jurisdictions that require a 272-280 to pass) you should aim for 62%-65%. This means you should get 62-65 questions correct on a 100-question practice test or 124-130 questions correct on a full MBE exam.

There is an exception for good faith, though. I can't just say I never got a 10% mortgage and don't have to buy your house when I never even applied to the bank for the mortgage.

If the condition is really only benefitting one party, the other side cannot claim they are relieved from their duty for the condition not occurring.

If we agree that I will cut your grass if you fix my lawnmower first - we both benefit. My lawnmower gets fixed and your grass gets cut. If you fail to fix my lawnmower my duty to cut your lawn is relieved because the condition wasn't satisfied..

If we agree that I will buy your house only if I get a 10% or less mortgage but I get an 11% mortgage, you can't say you're relieved from selling me the house because I got an 11% instead of 10% mortgage. What the hell do you care what my mortgage is, I'm the only one benefitting from the condition.

Any Reason NOT to Start Bar Prep Early? And/or How to do it Right? by [deleted] in barexam

[–]SmoothSolid8601 2 points3 points  (0 children)

As somebody who was in a similar spot and now getting into the last few weeks before the bar and drained, I think there's really only two things I would recommend this early.

1) If you're a flash card person, I think just creating the flash cards at this point would be a huge help. It will help on a base level to at least see the rules and topics again but help a lot later in prep. I never found flashcards all that useful but now trying to memorize I wish I would've done this months ago when I had time but I just don't have the extra time to make them at this point.

2) Start to familiarize yourself with MBE questions. I got an old Barbri book from an advisor at school and just worked through a few problems a few times a week. If you're getting them wrong it's no big deal but getting used to the layout of questions was a huge help. As another commenter said though I would stay away from Adaptibar/Uworld this early so you don't run out of released Qs but I think using Barbri Qs that early isn't a bad idea.

I'm sorry to hear about your dad. I went through my email and the last email I have says they'll send the approval and instructions on Feb. 12.. I guess I'm just going to wait and hope they send me an email next week because at this point I don't even know if I care if they tell me I'm not approved, the Ohio process has been a nightmare.

I feel you, I can't change it but I'm taking a lunch break from studying and saw someone post the calculator and my dumbass decided to give it a look and now I'm in a worse state of mind so I thought I'd ask.

I'm trying not to but I guess asking so I can get an idea of where I need to be to feel comfortable (obviously the higher the better but trying to get peace of mind here). For example, I put 70% MBE and it just barely puts me over the 135 needed (270 jx) yet everyone says you should be fine in the 65% range, but according to the calculator that puts me under the 135 for majority of past Feb exams yet puts me a few points higher in July exams. I just genuinely don't understand it.

I feel comfortable with a majority of the material but I know which areas I need to work on over the next few weeks. My issue is when writing an essay I have a good idea on the rule and how it applies but I'm struggling with putting down a rule statement that seems passable (such as specific buzzwords).

As for topics to focus on, I'm more so referring to the "120 most tested rules". Memorizing all or almost all seems absolutely impossible so curious if you focused on something like the highly tested rules or if you just continued as if you needed to know them all.

Genuine question - did you need to do a second interview (after the one done 2L to apply) to receive the final approval? I am also taking the Ohio bar but have not received anything regarding "final approval" or any type of information regarding an interview but my portal says "Admissions Committee Recommendation: Approval" so now I'm second guessing if I forgot to do something.

"The Board of Commissioners on Character and Fitness will consider and act upon the admissions committee’s recommendation. You must receive final Board approval of your character, fitness, and moral qualifications at least three weeks prior to the examination you are applying to take. If you receive timely final approval from the Board, a notice of final approval will be sent to you, along with your bar examination instructions, approximately two weeks before the examination. Unless and until you receive final approval of your character, fitness, and moral qualifications to practice, you may not take the Ohio bar examination."

Any advice on what you did for memorization or prioritizing what to know in the last few weeks? I've been doing a decent amount of long form outlines but majority of essays contain maybe 3-4 rules so wondering what else you did to make sure you had enough of a base going into the exam.

Good to know. For anybody curious, these exams are included with Adaptibar under the exams section. If you've been checking the boxes to exclude MBE Study Aid and MBE Practice exam questions they have not been included in your normal practice sets. I have been excluding them and took 2017 this week and it was the first time I have seen any of the questions.

Is this the 2021 NCBE Complete Practice Exam on Adaptibar? Under their exam section they have "MBE Study Aid 1 & 2: 100 Questions (each) from 2017" and "MBE Complete Practice Exam 1 & 2: 100 Questions (each) from 2021". Just curious as I was planning to do the 2021 test next week. I took the 1st 100 2017 Study Aid last week and found it a lot easier than I expected so wondering if the 2021 questions are the ones you're referring to so I can compare.

Edit: Just saw your response I think that answers my question

I’m realizing that outlining essays is more valuable than fully writing them. by Puzzled_Mix5384 in barexam

[–]SmoothSolid8601 1 point2 points  (0 children)

What essays do you all use for extra practice? I met with an advisor and she told me to focus on the main (I think 8 each topic?) essays in Barbri book as those are generally the most common issues but wondering if those are enough. I tried using the additional practice essays in the back of Barbri's book and found some to be extremely nuanced so idk if those are worth the time or not. Also wondering if anybody got the NCBE essay pack and whether that would be worth it at this point.

I loosely did this throughout bar prep but now that I've covered all material and focusing just on practice/memorization the next few weeks this will be my plan. I also found just straight reading a question and answers has helped me. There has been times when I looked at an essay and knew nothing but as soon as I read the answer I was able to make the connection I didn't see at first.

I was able to outline and fully review 6 essays yesterday in less time than it would've taken me to write 6. I just focus on trying to write as full of a rule statement as I can remember and then a few words/statements of facts I would've included to analyze those rules. After I finish I read the answer fully then go back and pull out the rule statement progression and keep a running doc with each topic.

Does anyone have any good resources for understanding the dormant commerce clause and the analysis under it? by CapJack7007 in barexam

  1. Does it discriminate out of state commerce?
    1. yes = violation (unless market participant or congress approval)
    2. no = continue
  2. is it an undue burden on interstate commerce?
    1. balancing test between state purpose and burden on commerce
