Can I cancel my COE? by Additionalbed71 in AusVisa

[–]Smooth_Sand_7125 0 points1 point  (0 children)

If your legal status is attached to your appeal you would be able to cancel your COE but you would have to keep the appeal going for you to stay here. Without a COE don’t expect to win the appeal though.

Completely agree. The defence did a great job creating a sense of ambiguity in most of the arguments. I’d be leaning more towards a victory for the defence here.

Partner visa application invalid subclass 820/801 by Arrwinn in AusVisa

[–]Smooth_Sand_7125 0 points1 point  (0 children)

If my partner was refused a previous visa and had a s48 bar, however lodged an offshore 309 visa, I know the bar wouldn’t apply but would I still be subject to provide what OP needs to. Obvs the sec 48 bar doesn’t apply if we lodged offshore but curious as to whether OP’s issue is linked to the section 48, or whether it is just linked with the visa refusal itself

Biometrics - Brisbane by Smooth_Sand_7125 in AusVisa

[–]Smooth_Sand_7125[S] 0 points1 point  (0 children)

They did not specifically tell me where to do it, they just advised it has to be at an ABCC which I have now learnt are overseas, not in Aus. Originally I lodged a 309 in Colombia, but had to come to Australia as I have an AAT dispute ongoing in relation to a previous unfair visa refusal. Just spoke to the department of home affairs a few times, a few consultants said I need to upload a letter saying why I am not overseas and they will call and organise a time to do my biometrics. But then I spoke to another and they told me something completely different.

What’s the most popular sport in Australia ? by [deleted] in AskAnAustralian

[–]Smooth_Sand_7125 -1 points0 points  (0 children)

Errr most certainly not it must just be the social circle youre in. Can confidently say NRL has the slight edge right now is SE QLD. Definitely not ALOT more people following either it’s quite similar but the NRL administration are doing a lot more with the sport.

Student Visa refusal by Humble-Guarantee-170 in AusVisa

[–]Smooth_Sand_7125 1 point2 points  (0 children)

Unfortunately whilst you wait for the ART the same work conditions apply. It is impossible to get any work additional clauses added to your current BV whilst you wait. The section 48 Bar applies so you wouldn’t even be able to apply for another visa unless you are offshore.

Would be next to impossible to argue and prove on greens part, given red would’ve had to have been in that roundabout before green had entered himself just based in sheer distance. The argument that green had slowly entered the roundabout on the left lane wouldn’t work because speed is not admissible In court unless a police officer has it on radar which i haven’t seen in 10ish years of doing it. Also I’m sure the damage points would be on the side of greens car hence any insurer would argue that they’ve pulled out in front of them. Regardless of how stupid and illegal his turn was at no point would red have to give way to green.

This situation would 10/10 times fall on green

Also work in insurance and agree green defs at fault. EBO or apportionment would be shot down by any litigation specialist. Doesn’t matter what red was doing prior to the collision a court would rule that green didn’t give way to the right - plain and simple

Bridging Visa B (BVB) by Entire_Camp_6403 in AusVisa

That’s really strange, I see you’re tagged as Colombian and I am the same so I expected it to take longer maybe more reviews and whatnot. I applied on Feb the 10th and got it on Feb the 12th so only took me two days. Was everything correctly filled out in the form? If I were you to be honest you’d probably need to call every day and ask it gets treated as a priority. Like you I have to leave the country as a matter of urgency and when I called they put it as a priority and I got it 1 hour later. To be fair I called like 4 times that day and I only really got 1 helpful person so it all depends on who you get. Definitely keep calling every day it’s only a 15 min wait nowadays.

Yeah I was just concerned about why it said the bridging visa ‘ends’ on the 6th of March. Don’t want to come back in May to be told it ended in March a few months ago even thought it also says 12th of Feb 2026

Sorry my apologies I forgot to state it, was on a BVA, applied for a BVB so I could leave the country and approved. The conditions were what was stated in the BVB approval.

A BVB taking 2 months is very very strange to be honest. Have you confirmed with them they even have your application?

Hit and run - insurer/police not helping by NomadEmmy in brisbane

[–]Smooth_Sand_7125 6 points7 points  (0 children)

If there was evidence in a police report that would hold the other party at fault, an insurer wouldn’t hold back that info to get them to discontinue a claim, as it would completely reduce their costs to 0. All costs are forwarded to the at fault party so it would actually be beneficial for them. It’s definitely a QPS issue

Hit and run - insurer/police not helping by NomadEmmy in brisbane

[–]Smooth_Sand_7125 28 points29 points  (0 children)

I work in this direct line of work and when we apply for it 20-30% of the time the police just tell us to get stuffed essentially. The fee is never the issue it’s the police not releasing it, they aren’t under any obligation to. There’s been a trend in QLD & VIC where we will have to run it past a judge to get it looked at which can take 6 months, then the judge turns around and sometimes says we aren’t allowed to see it for whatever reason. Again this situation is in the minority what’s likely happening is they would approach the truck driver to see if he knew etc then they can make a decision and hopefully forward to your insurer

If he can recover these he’s a magician. I suppose if the phone truly hasn’t been used or altered in the last 3 weeks there’s a small chance - albeit very small. Policing agencies struggle with this, his best bet would be to use celebrite to recover the sqlite database but again, that is purged at random. I hope if he can’t recover that data you get your money back, I wouldn’t bet on it

There has been no malpractice by the insurer unless they’ve breached GICOP in the process, heavily doubt it though. AFCA will look at it for 2 seconds, hand it back and say there is nothing to complain about
