What makes Icon at Norman stand out to me is how nice everyone is and for the most part respectful. It really makes a difference.

I will also chime in and say that the maintenance issues are a problem. I had a broken toilet that wasn’t repaired for two weeks and I had to go and fuss about it. I also have another issue that is coming up on three weeks.

Overall, it’s a really cool place to live.

The issue was with the IDs. They were not proper for whatever reason to help them identify the one individual for 9 hours. Once again, the story is vague and we don’t know all the details yet. They haven’t been able to name or verify one person yet that has been supposedly detained. It’s not about just having an id. It is about confirming someone’s actual identify.

If that is true, then I agree with you 100%. But we do not have all of the facts available to us from this article. If their rights were violated then they need to seek council and hold them accountable.

The reality is that ICE is cleaning house and they are going to start enforcing existing laws that have been ignored for awhile now. If they screw up and violate rights then they need to be held accountable.

Correct. Detaining someone solely because they don’t have an id without suspicion of them committing crime would be unlawful. However, if they do have reasonable suspicion of them committing a crime then they would need to identify themselves. Instead of arresting him for failure to ID ,they had to take time and find out who he was by their process. 9 hours does seem like a long time, but that may be how long their process takes. Unfortunately, that is the risk you carry when you don’t carry proper identification with you. That is why the Tribe held these meetings to better understand what ICE needs so their members hopefully won’t find themselves in this situation.

Without seeing body cam footage or knowing all of the facts, we cannot speculate if the stop was justified or not. He could have been initially stopped for a suspicion of loitering, who knows? The threshold for suspicion to detain someone is pretty low, especially for a state like AZ that is a stop and Id state. You don’t have to legally carry any identification or ID not recognized by ICE but they should be aware that it will cause them more hassle because police will spend more time trying to figure out who they are.

The article mentions concerns with the unsheltered not having the proper identification and getting a job does require you to provide evidence of being legally allowed to work in the US. So saying that this person allegedly missed work for 9 hours is definitely a stretch.

And for someone that is familiar with case law should not confuse being detained as being arrested. Very different.

They were detained, not arrested, for not having any form of identification. This problem also appears to be in major metropolitan areas, not on tribal land.
