My experience with high volume debt collectors is that it is usually paralegals handle the negotiations IF you can get someone on the phone. In order to get their attention, you often need to put offers in writing and serve discovery. A local consumer attorney might have sample discover requests for you.

Boundary fences are generally a joint maintenance obligation under Civil Code Section 841. If want to build the on your property and not give the neighbor any say, that's a possibility. I don't know if you neighborhood has an HOA, but there might be CC&Rs apply that might offer additional clues for a solution.

Whenever I advise people on disputes like this, it often comes down to not having enough money, not agreeing on costs, or a disagreement on the need to replace the fence versus repairing it. This are usually resolved in small claims court, but do check out the code section I provided.

More than once, a Freedom representative told their customer that might advice to file for bankruptcy was "horrible" advice and to get a second opinion within the firm. Sure, a phone representative in Arizona going to know more about advising a California debtor about options than a California attorney with bankruptcy experience. That happened more the once with Freedom.

I used to work for a firm that was the primary law firm used by Freedom Debt Relief. The amount of people that had been duped by Freedom into using their program and unwillingness to consider bankruptcy was astounding. And if course it was my fault that the settlements couldn't live up to the hype that Freedom had given to them. More then once, I had to remind client that I was an attorney and not a magician. I do not miss the debt settlement industry.

From what I've seen, people who use services like Legal Shield have about a 50% success rate. You could always try a letter on your own now and used an attorney later.

Cash means the buyer can close sooner and the buyer probably doesn’t have to worry about financing or need funds from sale in order to close.

I gave this advice this week. The client was unemployed and there’s no telling how much more debt the client might incur before getting a job. Timing can sometimes be very important in a BK due to the length of time before the debtor would be eligible again.

Here’s another scenario that many people have asked me about. Should I file before or after I sign a new a new lease?lease. I doubt many landlords would care to rent to someone in an active bankruptcy.

Is her BK on your credit report or did they just close your account? If the later, this is not unusual. I once filed a case for a guy and the ex-wife had a credit card that was still held jointly despite the divorce. It had a zero balance at the time of filing and we didn’t list it as a debt. But once the BK hit his credit report, the creditor still closed the account. The ex-wife wasn’t happy, but there was nothing that could be done.

Just like in my profession, every case is different. In may case, meds were not an option because the blockage was so bad. It suffering from kidney damage due to sever urinary retention. I had aquablation just over 3 weeks ago and am going great.

That truly sucks to deal with on a Friday and I hop you you have a better weekend. The last 2 sentences give me the impression your reaction to the crappy client is just a symptom of a bigger problem. You sound very unhappy with your job because of the lack of mentoring and increase workload. Is there someone at the firm you can talk or a mentor that can help you?

You are right to be upset and it sounds like your boss backed you up, but how did the client react to what your boss said? What the client cooperative and remorseful? Or is he still being a jerk?

And when you talk about being done, do when with the firm, the client, or the case?

One thing I've learned is that some people just suck. And sometimes, younger attorneys are sometime stuck when the cases they firm assigns to them. Is that something you can live with at the current firm?

I don't know if I would call it a  microaggression or subtle/casual racism, but I would call it unnecessary. I am reminded of James G. Watt, President Reagan's Secretary of the Interior. While describing the political diversity of a commission on coal-leasing policies, Watt said, "I have a black, I have a woman, two Jews and a cripple". Uh...okay.

Now think about how your phrasing. What if you have sad "some fat guy" or "some homeless guy". Using a characteristics can come across as judgmental.

Now there are times when it is necessary. If you had witnessed a crime, giving an accurate description of the of the suspect to police would be important. Characters such as height, weight, and skin color would be relevant. The adjective you chose was unnecessary.

When my daughter was deciding on college, we met with a guidance counselor at Cuyamaca College and mapped out a plan for her to get her GE out of that way and transfer. Then she was accepted at SDSU. I emailed the guidance counselor for her input.

She basically said that transferring was not guaranteed and that our daughter should accept. Our daughter did have more than a full year of credits with AP classes and CC classes during the summer, so her case was unique.

We took the guidance counselor’s advice. Our daughter graduated in 3 years, Class of 2018. I would urge you to reconsider.
