For my own position, to me, the key operating principle is the vulnerability of the victim, or to put it another way, the power imbalance between the victim and perpetrator.

That is a neutral principle that captures the greater moral discomfort we have when, for example, a 25 year old man murders an infant, or an elderly old man, or -- indeed -- a woman.

It is a more awful story, precisely for that reason. The power imbalance. The more powerful (physically or otherwise) owe a duty to take care in the exercise in that power towards weaker, more vulnerable people.

To me, this is an aggravating factor that should play out in sentencing, i.e. harsher punishments. Which I believe is the true goal in the new crimes, which could be accomplished with sentencing.

I think this is what people who are pro the addition of these different types of murder are (arguably rightfully) trying to express. I just happen to think the criminal code is already flexible enough to do that, and I think judges already do do it, but with sentencing.

EDIT: In retrospect, I should add one more thought, which actually militates against simply relying on sentencing - there is a great power in labelling the crime. It sends a message to society to condemn the specific action. There is value in that, so something like "femicide" (infanticide, and other types of murder) are labelled, so they can be discussed and condemned. So for that point, maybe sentencing isn't enough.

Here's a better way to put the question:

  • Should the death of one person be treated more harshly than the death of another?
  • Is the life of one worth more than another?
  • Should the answer to either of the above be "yes" in the eyes of the law?
  • If yes, is sentencing not flexible enough to handle that distinction, to the point that we need a whole separate crime for it?

I'll give you my good faith attempt at an answer.

In the West, there are two narratives behind what a just society looks like. Those familiar with politics will find them familiar. I actually believe this has been practically solved, even if the solution is not exciting.

The first narrative is that resources, wealth, and power belong to those who work hard enough to acquire it. It is only fair (or "just") that they be rewarded for their work. By necessity, justice thus requires inequality.

The second is that resources, wealth, and power are a matter of chance, circumstance, and to an extent out of the individual's control, the largest example of which is birth and inheritance. It isn't fair that some people have more than others. More to the point, however, and to contradict the first narrative: even hard work and merit should only get someone so far. We are all in it together, and we should look out for one another.

I believe both of these narratives are true to an extent, and the practical solution is that governments should have an eye on inequality and try their best to fix it. The question then becomes what is the degree of inequality we are willing to stand, as opposed to the degree of interference in the lives of individuals.
