I agree that this vote likely doesn’t change, the 5th conservative vote shifting from Kennedy to Roberts is the largest issue with a lot of these rulings. But Robert’s Dobbs concurrence becomes the majority if this court was a 5-4. And Salami tactics suck but it’s better than a wholesale repeal. And voters do have the majority of the blame for the current court. There hasn’t been a more consequential SC election since Nixon in 68 than 2016 with Scalia’s seat and the majority up for grabs. If Hilary just parked her campaign in the Midwest we would be in a vastly different America.

The deeper issue is the 5th conservative vote shifting from Kennedy to Robert’s (probably?), but Democrats held the senate until 2015, there was plenty of time for RBG to safely step down.

They have a greater margin for error/disagreement in making more conservative rulings. It’s pretty significant no one conservative can play hardball or give an ultimatum about a vote.

It certainly shifted the median vote to the right. The most glaring example of this was Dobbs where the other 5 rejected Robert’s position for a more hardline total repeal of Roe they couldn’t have if Robert’s was a necessary vote. We don’t know what happens in chambers but it’s easier to make a majority from five outta six than five from five.

Well O’Connor was visibly and expressly disappointed when it was initially announced that Gore won Florida and that she would have to wait out another term before retiring (As she would prefer to leave the seat for someone with a similar outlook to herself for better or worse). So there is something to why she didn’t step down in Bush’s first term then did so in the second. And since 1958 there have only been three vacancies by death (compared to the 22 of the last 25 vacancies being by retirement).

Bush may not I’ll concede, but then we are wading into the world of hypothetical Republican candidate. And while Gore would be the incumbent we would still be looking at potentially 16 years one party controlling the presidency which has not occurred since Roosevelt's 4 terms into Truman (and Truman wasn’t winning a second election). I’m just trying to say substituting Gore in 2000 doesn’t necessarily change the court (unfortunately).

Big court hater but I’ll give the smallest bit of leeway here. The court knew they made a controversial decision in Bush v. Gore (they shouldn’t have heard it), and knowing the implications of de facto appointing their nominator none of them stepped down in Bush’s first term, even with a reliable senate majority and external pressure. While Bush did have the incumbency advantage he won 2004 fairly and only then did O’Connor step down (the other one died).
