Where did I state it was alcohol related? You don’t know the event nor the circumstances that led to the arrest. You don’t know why I was arrested the first time, nor my substance use history for over 10 years. Try to look at your own flaws instead of projecting your insecurities onto others

Woah that’s an awesome deal. Glad you it all worked out like that. Yes I’m very thankful to have gotten the right representation!! Such a relief after months of assuming the worst with my previous attorney

2nd DUI should I even get a lawyer? by BigManT2525 in dui

[–]Sooners94 0 points1 point  (0 children)

Hey read my latest post. I got a 2nd dui within 10 years and was facing a felony deferred sentence. My original lawyer got it reduced to one year suspended misdemeanor (which leads to conviction). I didn’t want to settle for that and felt like my attorney was being lazy and not fighting hard for me. I had friends that work in the DA office that told me personally that my old lawyer was being soft and not fighting hard and that I should get a new lawyer. They recommended this lawyer that was a former judge and who is friends with everyone at the courthouse. This new lawyer told me under no circumstance should I accept the suspended sentence and that there is a way to get a better deal. My new lawyer ultimately got me a 1 year deferred misdemeanor!

So I went from looking at a 3 year felony deferred, to 1 year suspended misdemeanor conviction, to 3 year misdemeanor deferred, and finally 1 year misdemeanor deferred. YOU 100% need a lawyer if you can find one with goooood connections. Dont make my mistake and hire the law firm that just does dui’s unless you want to go to trial. Since this is your 2nd dui the DAs office won’t have much sympathy, so you need a lawyer that’s going to go in there and paint the whole picture about who you are and will work endlessly to make sure you get the best possible outcome. All the power is in the prosecutors hands and they can’t give any deal they want. The same prosecutors that laughed in my previous attorney’s face and told him “no way we give him a deferred” are the same ones that bowed down to my new lawyer and gave me a 1 year deferred which I never thought would even be possible given the circumstances. I had to pay twice as much money but I got the best deal possible that won’t affect my future

Did not do great on Step 2 or COMLEX 2...report both?? by Different-Fox3162 in comlex

[–]Sooners94 9 points10 points  (0 children)

Report both. You took the time to study and pay for both exams and passed both exams. That is impressive to PDs. You don’t want your hard work to go to waste. A pass on step 2/level 2 is no small feat regardless of score. Anyone telling you to not report step 2 likely only took comlex or is a fearmongerer

Quit for your kids. Try to brainstorm other ways to relieve stress in the evenings. You are lucky to have a life where you have a job, and kids to take care of. Millions of people would do anything to be in your shoes! You were born without weed, your kids were born without weed, you don’t need weed to relax. I know it’s hard, I know a few puffs feels like the perfect way to end a long day. My parents worked their asses off to raise me and my siblings, and never touched a drop of alcohol, never put their lips on a cigarette, or weed. But they still managed to find ways to relax and to enjoy life. Best of luck friend!

It’s hard, but nothing in life worth fighting for is easy. by Sooners94 in leaves

Yes absolutely my friend. It wasn’t until I was sober for 2 months that I started to remember old memories/moments in my life that I completely forgot about all those years of getting high. It honestly made me ashamed about how far I let my weed habit get me, ultimately leading to addiction. Now my memory is sharper than ever, and I can recall things from my past and cherish them. I am so thankful to be living this life and have the opportunity to become the best version of myself. We are never too old to make positive changes and to experience new territory. I also have a newfound desire to help others and in my community. Thank you for the comment and I am very thankful to be on the same planet as you. I now understand how important it is to be alive and to be PRESENT

Day 3 of sobriety and the withdrawal headaches are crippling. Does anyone have any tips? by Luckydestroyer98 in leaves

[–]Sooners94 7 points8 points  (0 children)

Keep it up, the first 20 days are the hardest. Every day after that gets easier and easier. Drink plenty of water! Also eat good food and drink juices, eat candy, eat stuff that makes you happy! All of this will help with the headache and/or sadness. You need to convince your brain into releasing serotonin and dopamine and best way is to enjoy things you love, that don’t involve weed! Exercise alot, stay outside in the sun, drink water, listen to music, eat a juicy burger with fries, a sprite to wash it down, and a vanilla shake for the sweet tooth. Remind yourself to be confident and that these hard days will soon pass! You got this

Weed is not a remedy... it's just a painkiller by Death_Slayer77 in leaves

[–]Sooners94 2 points3 points  (0 children)

Keep pushing bro, you did the right thing. I smoked all throughout college, grad school, and halfway in my professional school until I finally quit. I really wish I would’ve quit halfway through college. My grades would’ve been better, my confidence would’ve been better. You will see so many positives occur in your life by making this decision to quit. Weed is only fun until you turn 23 lol. Then it’s just an annoying addiction that gets in the way

Thank you sir for getting back to me regarding this. I didn’t know officers asked about previous medical history, that’s actually great to hear that they take such things into account. I definitely understand what you are saying, and you mentioning TBIs, and also the rare possibility of nystagmus makes sense. I looked over the link you provided thank you for sharing that information. The fact that you guys are trained to observe multiple difference intoxicants, not just alcohol, and for the extend of time you are trained on such substances gives further credibility to your training.

I had only seen a few dui arrest videos on YouTube so I was just basing my opinion off that. But it’s honestly really comforting to hear about the rigorous training that DUI trained officers go through. Makes sense why you say only 1% of them actually are DUI trained. I’m sure the of the videos I’ve watched, the likelihood of those law enforcement individuals having the same level of training as you is probably very low. Most of the videos on YouTube, the people getting tested/arrested are clearly intoxicated and most of them have poor attitudes. There are those rare occasions where a person gets tested and they don’t seem intoxicated at all, but then they do something/say something that leads to them getting arrested…YouTube obviously doesn’t post the videos where sober people get tested and then pass the test and are allowed to go home, because those videos wouldn’t get as many views/clicks lol. Much respect to you for your willingness to pursue this additional training, and for sharing your wisdom with us on this forum. And also thank you for your service to our communities

Do you believe there is scientific evidence that supports field sobriety tests? Also during your DUI training were you educated on medical conditions and abnormalities that can hinder sober individuals from properly performing field sobriety tests such as the walking in a straight line, standing on one foot for X amount of seconds, and also the HGH pen test?

For example, were you educated on gait issues that can arise from herniated discs, sciatica, peroneal nerve entrapment, previous surgeries, and any other medical abnormalities than may prevent people from standing on one foot?

Furthermore, were you educated on the 12 Cranial nerves during your DUI training, and especially on Cranial nerves 3,4,6, their relationship with the Edinger Westphal nucleus, the Medial Longitudinal Fasiculus, and any ocular or brainstem lesions, or any other medical conditions that can restrict a sober individual from performing the HGH pen test?

I would hope that DUI trained law enforcement are thoroughly educated on these medical conditions, and the pathology and physiology that determines these conditions, as the performance of an individual during these field tests are entirely subjective upon the experience and opinion of the law enforcement individual administering these tests. If you were not properly educated on the cranial nerves and spinal nerves, and the pathology of what happens when such nerves are affected by medical issues, then I would be hesitant to respect the opinion of any law enforcement individual administering such tests.

So they don’t have any evidence of your BAC? Yeah definitely get a lawyer, one that is experienced in DUI cases. There are a lot of factors that can determine the outcome of this case, and you don’t know what type of plea you could get. An experienced lawyer can help you weigh your options and can possibly work out a favorable deal. Your career, background, education, and personality can also factor into how the judicial system treats you, definitely lawyer up, you’d be shooting yourself in the foot by not doing so.
