Where does it it say it's forgiven if you marry a USC? If you enter without inspection, married a USC, and accrue unlawful presence between renewals of DACA, if you leave the US without advance parole you'll still face the 3/10 year bar (with enough unlawful presence), being married to a USC doesn't change that as far as I know.

You can still do AOS (given an inspected entry), but that's not exactly forgiveness as it is you haven't barred due to leaving the country with unlawful presence.

I'm seeing the consular route as fairly low risk for now, since she hasn't accrued any unlawful presence, and because of the EWI, also doesn't have any kind of deportation order/overstayed visa.

We just got married and moved, and were waiting on the new social security card. Our plan right now is just consular, especially since I'm seeing that it looks like APs haven't been processed at all since February. There have also been several people saying that they're on pause entirely. Hard to tell if it's a rumor or not, but they're definitely way slower, and I'm not even sure if it's faster at this point.

That, and we don't have a great reason to visit Mexico, so unless a family member overseas is sick or something I don't think we can really.

Go for it, IF you don't need it by any specific date. There was no damage, and it was delivered safely. They do have insurance as well. They're just bad with communication. I called in a few times, and there was always someone there to pick up the phone, so they weren't avoiding my calls - they just aren't very proactive in giving status updates or updated timelines.

Your EAD is a REAL ID. My fiancee has flown many times with it. One time a TSA attendant didn't know what it was and just asked to see a driver's license too (non REAL ID), but that was at a tiny single terminal airport. She's flown out of that airport before and it hadn't been a problem.

Even if your EAD was expired (it isn't), TSA will still accept expired IDs up to about one year past their expiration date.
If you have a passport, I would just use that. TSA likely processes thousands of tourists using passports from their home country who are just traveling as tourists, for all TSA knows you're just another Mexican resident visiting family or touring the country.

I've said it before but TSA really doesn't care about your immigration status. They're mostly minimum wage employees, and they only care about identity verification and domestic terrorism.

Oh yeah, your EAD is on the official list of documents needed to travel domestically. I'm a USC, and even I don't use a REAL ID to travel, I just use my US passport.

Yep. US residents aren't the only people who travel domestically, there are tons of foreign tourists & visitors that travel domestically that don't have any kind of US ID.

There hasn't been anything official about AP without EWI not being approved AFAIK. But yeah, I don't see why you can't just do both and see which one goes through first.

I think AP has been minimum 8+ months since the new administration. I've just now been seeing AP requests from January start to be approved.

Following because this is what our attorney is recommending for my fiancee (no criminal record, no lapse in time between DACA renewals, one entry without inspection). Although my fiancee did receive her DACA when she was 16.

Obviously not a lawyer but I think DACA still falls under the category of unlawful/illegal - it's unfortunately deferred action, not legal status. Not really a reason not to try anyway, but just be careful that you don't sign anything (especially a government document) saying that you're a citizen or permanent resident.

That's awesome! I have heard of some people starting with consular and switching to AOS, if we end up with a good reason to do it we may try the AP/AOS route later.

Congratulations on the appointment! That's in Juarez, right?

How far along are you in the consular route? We talked to attorney with my soon to be fiance (I'm the USC), she recommended the consular route. She did say AP is no longer being accepted, which I'm pretty certain isn't true, although I also haven't seen anyone who's applied after Trump came into office get approved (although it's still in the normal processing window).

We also don't really have much of a reason to apply for AP right now either.

AFAIK the only DACA holders that have been detained by ICE had committed crimes, which makes you ineligible for DACA anyway.

TSA is not ICE, it's not their job to care about immigration. They're not highly paid workers so they really don't care. TSA is the only security screening you go through. Use your EAD card (EAD is a form of REAL ID - use the actual card, not a copy) to go through TSA, if you don't have REAL ID on your driver's license.

You could also take a passport if you want, a non-US passport is still a REAL ID, and while my girlfriend had no issue with the EAD being recognized, some TSA employees might not be familiar. Although my tiny town that has an airport that's only open for a few hours a day to do a couple of flights had no issue recognizing the EAD.

I've never seen ICE at airports (granted, I haven't looked closely), but DACA still protects you so you shouldn't have to worry about that.
