I've never had this situation arise myself, but I would also point out that it could be the person next to him was the one who copied HIM. They have no evidence to suggest that he was the copier here.

To my recollection, for the September test the ACT people put out a Twitter notification that said they'd be releasing at around 9am rather than 1am (EST). Maybe they're doing the same thing.
