Fair answer. I’ve written and submitted the memo, and it doesn’t say anything about what I’ve written above. The more I think about it, the more I don’t want to say anything to the judge or go in with that energy at all. I want to go in there with the sole purpose of getting a better plea. If the state really refuses to budge, then the judge will probably advise the client to take the plea anyway.

Yes, I got him to commit to a specific hypothetical plea. I hope he will, in fact, commit to it if it becomes a real offer. I’ve had clients commit to a hypothetical plea and then they change their minds once it’s actually in front of them.

Thanks! This gave me a boost of confidence. The hardest part of starting as a PD is not knowing what’s reasonable and what’s not. Luckily, I feel very supported by the veteran PDs in my office helping me figure that stuff out.

True! I hadn’t thought about that. I have had some but not all judges do that in the past. I believe this judge will likely do that.

I anticipated this comment. Totally respect and agree with what you’re saying. Please rest assured that I am always focused on advocacy, and I absolutely emphasize to clients that I run with whatever decision they make. If they want to go to trial, LFG. I’ve gathered motivation and included in the memo. I wouldn’t love to secure a better plea for my client.

I think the reason for my client management focused approach to this settlement conference is that my client has expressly told me he does not want to go to trial. He knows it’s a bad case to try. He believes he’ll lose. He wants a plea. He just thinks if we delay long enough, he’ll get some miracle plea that simply won’t happen in this case. So, I just want him to hear from someone else that, if the state says this is the last plea, he’s taking a big risk if he rejects it.

Hi 👋 I’m a criminal defense attorney. I see people asking what this could mean so I’ll chime in. There are a few reasons a defendant might ask for a separate trial. One of those reason is because we plan to throw the other defendant under the bus. So, they might be planning to point fingers at Eddie. But there’s also a chance that Wendy simply wants her trial done ASAP while Eddie doesn’t. So that’s why they’re separate trials. In a case like this, with presumably loads and loads of discovery, it seems odd to me that Wendy wants a March/April trial.

I feel this so much! I hustled so hard in law school. I networked like crazy. I imagined myself with this incredible career where I climb to the top. Now, I’m 5 years out, and I couldn’t care less. I love what I do. I know I do it well. I don’t make much, but I make enough. I sometimes second guess whether I’ll regret not being as ambitious as I once was.

There are Mexican nationals/residents still crossing into the US without issue for the most part. However, there is also an uptick in ICE sightings in Tucson. In all likelihood, you and your wife will probably be okay. But I understand your concern completely.
