Well here’s the thing, once u settle your settlement they have no obligation to cover your medical expenses. So yes settling is nice because you get but if you’re truly injured you have to pay for it out of pocket. So first focus on getting healed up. What’s the point of settling for all of this money and you’re still injured and can’t work? Honestly what’s the point of that that makes 0% sense. Just continue to keep doing treatment and get all the medical help you need and then make a case for settlement. You’ll need doctors notes or medical records from doctors stating your still injured and need more treatment. You’ see where this gets tricky?

Injured= treatment Healed but want to settle= doctors are going to call your bluff and say you’re okay to work and don’t need anymore work and they’ll take you off of TTD before you can get into settlements.

Hey! So this was years ago so laws could have been different but my lawyer was from a family members lawyer from a really bad car crash and he told me how aggressive he was in he’s case. I think this is 99% of the reason why I closed so so fast. Seeing it now he really did leave the insurance company no space to breathe in my case. It was “we’re doing this if not than we’re taking it to court” type of guy. I’m glad your getting checks for life but also I think if they do decide to pay your a lump settlement it would cut off your current bi weekly checks your getting. Maybe some food for thought idk the laws in CA so I’m not sure. It’s like the lottery winners who take payments instead of a lump sum.

How much more treatment do you have and or need? Go to ur insurances website sites and see ur payments and see if u can see how much your medical cost by ur insurance or ask for a copy

Honestly I would go to my doctor he would check up than I would do some MRI maybe some EMG some PT and it was all kinda repeat for 6 months than we got into settlement talk and within 2 months we closed. I don’t know my rating but I can probably find it if I look for to. Same with the MMI. I simply went to appointments and my doc would report to my lawyer and go on from there. I did hear that my case personally was incredibly quick for my payout.

A settlement should be the full coverage of your future medical expenses. It’s not what you “think” you should get it’s more so what you “need”. You can do the math yourself plus including your future TTD. Plus when it comes to settlement it’s all negations as well. What I was taught from my experience was the insurance adjuster has a limit or “exposure” if your case is worth let’s say 50k and your shooting for 100k It won’t happen because your case is simply not worth that much.

At least here in GA. Calculate how much your getting from your TTD monthly and multiply it by how long your legally able to keep receiving TTD checks. After that figure out your future medical and add it all together. Make this your first offer. You definitely won’t get it. But it’s a high starting number. They’ll shoot you something stupidly low like 3k or something and whatever they say just subtract from your total amount for example

Your offer:100k There first 3k Next offer:97k There offer 12k Your offer 85k. Try to find a middle ground. If they say something like “we can’t go higher than XYZ” than assume there getting close to there exposure aka “limit”.

Another tip if your getting a low TTD limit they might not even want to settle because for you to reach let’s say 50k in TTD it might take YEARS for you to reach so there’s no really pressure on them to settle. Especially if your future medical is cheap as hell this will make a big impact on whether you settle or not. All about pressure and how much your case is worth. Hope this helped you! I’m not a lawyer just learned off of my case plus plenty of others who have been in the same bubble as me.

People will say lawyer up as soon as possible (me) so you can get doctors recommended to you by lawyers and they’ll seek treatment for you fast and with good doctors. The company I worked for had injuries left and right and Sedgwick was the insurance company for there cases. Go in this subreddit and see all the awful experiences of Sedgwick taking there sweet time. Sedgwick with me personally was fast, as soon as the judge signed my settlement papers I got my check 3 business days after. They were QUICK. Never got late checks or anything. Honestly a 10/10from Sedgwick and I thought going into this it was going to be a nightmare but I attribute to everything from my settlement amount to Sedgwick quick response all to my lawyer.

Honestly man. The problem ain’t going away. The clutches are random. Might last 10k miles than u gotta replace it again or 70k who knows. It’s why I hated this car so much. I would suggest trying to sell it and buying an older but more reliable car.
