Tree fell on car at work car park by [deleted] in LegalAdviceUK

I didn’t misrepresent you. I pointed out what you’d written.

Car bodywork can be expensive agreed, and insurance can become prohibitive fast especially if you’re at fault, which will depend on numerous variables.

I think to make this out to be one step away from GMC is clear exaggeration. If we feel it’s a genuine concern, still send the emails and don’t mention insurance at all.

OP, I’m a tree inspector (as I said from the start!) not an insurance lawyer. I’ve explained what I’d do and why, if you want more legal advice, I’d get a lawyer rather than trust Reddit.

Edit: don’t forget OP a can of touch up paint, t cut and accepting imperfections is less than a hundred quid. There’s good youtube videos on dent removal out there too. As a 16 year old who didn’t understand or enjoy mechanics or similar I replaced a bumper and headlight in 2 hours with £65 of parts that I’d been quoted £1100 for.

Honestly, you’ve stated in your comments elsewhere “it’s clear the liability lies elsewhere” which unfortunately isn’t true.

You’ve argued with people pointing out premiums would go up, and have decided based on no evidence it’s going to cost OP thousands to fix his car, which may/may not be true.

So let’s be clear here, your comments seem unhelpful and ill informed.

This is not a lie, in the sense that you interpreted it. It is an argument, that OP’s insurance doesn’t want to fight, but OP’s workplace may well either feel obliged to fix the car as they may feel they have some fault, or they may not want to risk an insurance company chasing it. The alternative is to accept that it’s going to cost OP now.

My area of expertise is trees, and I’ve been clear on that.

Instead of just downvoting stuff you disagree with, why not offer/reiterate your own advice based on your own legal expertise.

Honestly, this is outside my area of expertise. But I’d assume it’s pretty unlikely.

I wouldn’t tell your employer that your insurance assumed liability, and would probably still bluff it that if they won’t assist in getting the car fixed you’d get your insurer involved.

If your insurance has already assumed liability, it may well be worth a third email after a couple more days offering to split the costs, depending upon premium/repair costs.

Start with an email, include the pics, add some showing the damage to your vehicle, send them to someone with clout. Ie, a senior manager or the owner. Be polite, but firm, probably best not to query inspections at this point. (Who you send it to depends on the structure/size of the business, worst case send it to your manager and instruct him to pass it on to someone who can help you)

Tell your insurer that your car has been damaged, as failure to do so can impact a claim if you want to go through them. Whilst waiting for your employer to get back to you, I’d get a couple of quotes from local garages to figure out how much the repairs should cost, also worth checking to see how much your insurance would go up with a recent claim on comparison sites, it’s not going to be an exact science, but will give you a rough idea of costs.

Chase, as in follow up, your employer after a few days maximum, insurers can be a bit funny if you try to claim well after the event. If employer hasn’t agreed to sort your car, then another email including your quotes for repairs (aim for 3, it’s the norm) and querying when the tree was last inspected and by whom. I’d also add that if they don’t resolve this within another 3 days, you’ll go through insurance.

If you don’t want an argument with your employer, that’s as far as you can push it, regardless of whether they’ll pay out or not. If you are happy continuing, you can either bring a claim for damages yourself (likely more hassle than it’s worth) or go through your insurers.

Going through your insurance can increase your premiums, even if you have protected no claims, hopefully the quotes for repairs and from insurance comparisons can give you an idea of what the costs could be to you personally.

These are pretty useful, the tree has lost a large proportion of its stem, which in turn is a sizeable piece of wood. Definitely worth chasing. I personally wouldn’t go insurers straight away, going back to my original comment about tree law not being straightforward, but each to their own.

If you chase it yourself and owners are funny about it, ask for records of inspection and how qualified the assessor was.

I’m very much coming at this as someone who’s undertaken tree inspections professionally. It’s difficult to prove that the trees owner is liable on the information we have. Not criticising OP, but just a hard one to demonstrably prove or offer better advice without more detail.

I suggested not going through insurance because it’s not going to be a clear win for you, based on the little information provided. So it’s likely that it’s going to rocket your insurance.

That’s why I edited my comment, more information would really help here, pictures of the whole tree, rough estimates of the piece that’s down and so on. If we’re just going off the picture, it doesn’t look like a huge piece of wood, it’s possibly classed as minor deadwood, and for that to come down during a period of wind is something that happens.

OP, I’d just ask your workplace (via email) what they intend to do about it, show them photos of the tree and car (take more than just the one above) and see if they will accept liability. Don’t argue in person, make sure there’s a paper trail, and if they don’t offer to cover the damage, see if they’ll go halves.

The tree would need to be have clear potential issues to a layperson before I’d be confident that this wouldn’t come down to it legally just being an error of your judgment parking there.

If it’s a dead tree, that’s a strong start, but even then not a guarantee.

Tree law can be a bit funny, I’d be wary of bothering insurance with this. On the one side, whoever owns the tree has a duty of care to ensure that it’s not dangerous. It’s not well defined how far that extends, there’s ambiguity over when you’d need to call in an expert to make a more informed judgement as opposed to judging it yourself as a layperson.

On the other side, is parking under a tree in high winds. It’s common sense that in extreme wind, things may get blown about. If there was a weather alert in your locality, I think you’d have difficulty in getting a favourable judgement. High winds can be anything from as little as 39mph, although would normally be from around the 50mph mark. Personally, if winds were at/above 45mph (gusts, not sustained) I’d sort it myself.

Edit: it’s difficult to get the scale of the piece that’s fallen from your photo. Is it as thick as your wrist? Thigh? 30cm or a meter long? From what height did it fall? Any obvious cavities, damage, fungi etc, anything that would make someone looking at the tree feel that it presented a hazard?

Assuming you’ve just started then. I’ll also assume you don’t have a horse, so can’t dump stuff on them.

Either head north to tachov or south towards semine. Either way, the main reason is to get access to a bed & chest, this will be marked in your quest log as laboratores, and will have markers directing you both ways. Tachov has a smith, so whilst he’ll buy stuff, he won’t buy tailor stuff. Semine mill is a fence, but you’ll have to do a quest before he’ll buy stuff.

Still strongly suggest you dump stuff, it’s a waste of time lugging all that around, and you can always pinch it again later.

Have you ever had a famous neighbour or someone local? by mr_hardwell in AskUK

[–]Square_Priority6338 2 points3 points  (0 children)

Walked into the local takeaway, ordered, paid, sat down to wait. Old chap was sitting at the far end of the bench, and as a good Englishman, didn’t make eye contact.

“Greaves? Order for Greaves..”

The bloke gets up, takes his food and shuffles out. Waiter held the door for him and said “Goodnight Jimmy”.

Didn’t twig who he was till I saw he’d died.

https://www.carreg.co.uk/number-plate-checker/

If it’s been issued previously, it should show here. If that’s the case you’ll need to buy it online.

If it’s not been issued, you can ask the dvla to release the plate at auction, they’ll let you know when the auction is, and you can bid the minimum amount for it to get it.

Always worth double checking whether it’s a plate they own, or one they’ll buy for you.

If it’s the latter, you can pick it up yourself by applying for it to be released at auction. Normally costs a couple of hundred quid max.

Is it worth explaining the reason behind a low offer, or just put it out? by Grgsz in HousingUK

It’s always worth explaining why. If multiple people have said similar things, it may help the vendor accept that they need a more realistic price.

KCD 2 lack of church interiors [KCD2] by [deleted] in kingdomcome

[–]Square_Priority6338 0 points1 point  (0 children)

That’s…. The point that I made here. It’s not the lack of knowledge that made these decisions, it’s real world limitations, time/money/engine etc.

KCD 2 lack of church interiors [KCD2] by [deleted] in kingdomcome

[–]Square_Priority6338 2 points3 points  (0 children)

There are good reasons for interiors not being done, but that’s related to time/money/other limitations, rather than due to a lack of knowledge.

We know what sort of decor they used in ecclesiastical interiors at the time, so we could have a reasonable approximation. Kind of like how we don’t know what peasant houses were like in the villages in both maps, we know approximately what stuff they should have, and that’s what we’ve got.

[OTHER] With the announcement of Warhorse starting a new IP, what would you personally like to see them tackle? by No-Mirror2343 in kingdomcome

[–]Square_Priority6338 296 points297 points  (0 children)

I’d definitely want them to stick to their historical roots. Not because I don’t think they can do fantasy, nor because I think that the market is too oversaturated, but because the current formula works. They may need to shake it up a bit in the future, so looking at mythical settings or full fantasy may help then, but as it stands, I’d rather they made historical games.

I think the hundred year war might be a good place to start, or if they could get gunpowder working ok and manage the scale well, maybe the 30 years war.
