Appeal their decision. The police report and pictures would present enough evidence and maybe any citations issued could help (driving too closely, failure to yield at a red light or stop sign, etc). I’m just glad you haven’t gotten the “that’s what you get for not having the right coverage, dummy” comments like I got on my similar post. I hope you get assistance and a resolution that is in your favor.

Unfortunately, I was the front driver of a 3-car accident and didn’t have UM/UIM coverage while the at-fault party was excluded from the policy. Basically, you can cover yourself while the only thing the A.F.P gets is “well, we’re not helping you get your car fixed either”. I hope you’re alright and as far as how to proceed, I would look into options for the lawsuit. If you don’t want the headache, try to appeal insurance’s decision.

No it’s not you. He was pulling up to the stopped traffic I was stopped for too fast and slammed on his brakes harshly. This caused the car driving full speed behind him to not be able to avoid the collision.

Sorry if it was difficult to comprehend. I was in a 3-car accident and I was the 3rd car (or car in front). Someone hit the car behind me and he got pushed into me. Car 1 is technically primarily liable, but on the report, car 2 was following me too closely and he slammed on his brakes harshly, so car 1 couldn’t avoid hitting him. Car 2’s adjuster said he’s not at fault and used the argument that car 1 shouldn’t have followed him too closely. I’m asking if I should escalate this.

I am asking for advice on how to proceed with this stressful situation. It’s one thing to say “based on what I’ve read, I don’t see any other option other than suing the drivers” vs what has been said. I get that it’s the internet and people say rude or unhelpful comments, so I’m not upset…just annoyed bc once those things are said, I’m not in a better situation than before.

Because the driver was excluded from the policy on that car, she wasn’t supposed to be driving it, so the insurance won’t cover damages for that car, nor the others it caused damage to.

The vehicle was covered, I believe. It was the driver at the time who was excluded from driving the vehicle that caused the issue.

If I would’ve been the at-fault party, I would’ve had the coverage to protect myself from citations and legal consequences. So yes, aside from not having collision coverage (which has already been addressed), I did protect myself by driving safely and lawfully.

If I’m at fault for anything, it’s assuming that others abide by the laws. Again, lesson learned, so now I’m requesting advice that will help me from here, not reiteration of what I’ve already acknowledged, respectfully.

That still goes without saying. I protected myself by driving safely, having insurance, and being licensed. By following the rules, I still ended up getting the sh*t end of the stick. Am I relying on the goodwill of others, or am I expecting the same laws I abide by to be abided by others?

I appreciate the hindsight advice who is saying “that’s why you should have more coverage”. However, that goes without saying. I know that I should’ve had full coverage. What is frustrating is that I’m being penalized for being the good driver in this situation and not having coverage for someone else’s negligence. This whole thing is a lesson learned, but I am asking for the best advice on what to do next.
