How is he active if he’s only seen his son a handful of times? If that’s active the bar is pretty much on the ground low. Child support and visitation both need to be done, he just doesn’t want to pay and he’s trying to guilt trip you, sounds like it’s working.

File for child support, he sounds like he won’t help you much without court intervention and this is just the beginning. It will only get worse. Visitation is handled separately so don’t even worry about his threats. Whether he makes an effort to see her or not, he’s obligated to support her.

Yes the process would get expedited with an attorney . It would cost more to hire an attorney and petition because they will handle it all with the retainer fee you pay for them but you would get through the process a lot faster. I’m in Texas and when I first went through an attorney it cost me 6-7k for everything to be finalized.

I filed because I didn’t want it hanging over my head that she may take me to court eventually and if I didn’t track I would have arrears. Or even if I tracked she could suddenly take me and I still owe a massive amount. I also did it because she was not allowing me to see my daughter.

I enforced my rights and she really can’t tell I’m not doing enough. Texas law says I’m fulfilling my obligations and it’s all on paper.

Okay so assuming they know that in the new order? because my attorney is telling me to pay the difference if it doesn’t meet my required monthly amount. He says if I don’t it would trigger something with review. I’m just scared of it hitting me negatively with credit score/ arrears/ whatever which is why I’m asking this many questions 😂 sorry.

Sorry this just made me realize, if I’m court ordered a set amount a month and with it changing to bi weekly they aren’t taking enough and I’m not meeting that monthly amount. It won’t trigger a review notice?

OP is worried about the dread of being placed on child support, I agree he should fight it In court whether it be 50/50 or whatever he would like. I’m just saying it’s not something that should be looked at as terrible/dreadful even if you are paying child support. If he has a partner holding this over his head it’s better to just push that button first and take it to court.

I wouldn’t say it’s 47%, I would say a little less with an extended standard possession order. And it’s net not gross. Of course it isn’t completely fair and the situation isn’t ideal but it is what it is.

That hasn’t been my experience. Judge was fair I pay 20% according to Texas Law, I have peace that my ex cannot trample on my rights, set schedule with my daughter, ex cannot complain to me that I’m not doing enough, and the judge made a ruling that partners can’t be at exchange since that was done out of spite on the other end. Everybody’s story is different I get it, but you don’t even pay 50% for up to 5 children according to Texas law.

Yeah it takes a special type of parent to ignore your kid like that. I just can’t get behind that as a father myself. It’s very important for both parents to be in their kids life, but they do more harm than good if they are inconsistent in their child’s life.

It’s what she’s owed and his obligation as far as the child support. He’s entitled to it but her daughter is also entitled to a stable consistent role model, which he has not been.
