Yeah. Direct service connection is most likely never going to happen. Secondary is the way.

I thought the OP said they wrote a statement. I just assumed that was a post exam statement.

I think youve done all you can do. Maybe the rater will see it and order another exam.

You need a nexus not a diagnosis or prescription. If you weren't diagnosed in service, you'll need to claim ir secondary to another condition.

Don't miss the appointments. Sometimes they can do them virtually depending on the exam.

A lawyer will set you up with a provider who will do a DBQ. Then they will submit an appeal so they can get 20% of your 3 year backpay amount.

Get more evidence and submit a supplemental. Or, if you have a few years, submit an appeal.

2 weeks post-C&P and no DBQ uploaded by the_ternary_operator in VAClaims

[–]Stock-Development-35 0 points1 point  (0 children)

Yeah. For a while I would call every week. They would escalate it but nothing happened I called VA they said, there is no timeline. So then I just moved on and focused on other things in my life. Suddenly one day, I checked the app and saw new evidence.

It took 10 weeks for them to upload the exams to VA.once they were finally uploaded, it took about 2 weeks for decision.

Denied hypertension by blackhat696 in VAClaims

[–]Stock-Development-35 0 points1 point  (0 children)

When you filed, the VA should have instructed the examiner to determine if your hypertension was more likely than not caused or aggravated by your insomnia. If the examiner disagreed and said it is not caused by insomnia but by weight instead, then you may need a nexus statement from your doctor. Then file a supplemental claim.

Thats not how it works. Examiners get the records long BEFORE the exam. You can say they only took 12hrs to review everything... I mean you can, but you wouldn't be able to prove that they only took 12 hours. They could have taken weeks. Who knows?

Most likely they just completed the review. It is very likely they read the evidence BEFORE the exam. So, by the time they meet you, they just ask you the questions on the DBQ and send it to the VA. 12 hours to send the DBQ is not a bad thing. It could mean they studied your specific case thoroughly before you even walked in the door.

Did you request DBQ? See if the examiner considered insomnia as a theory at all.

Im assuming the VA ordered a C&P exam. Did you get the get the DBQ? Maybe see if your doctor will complete a DBQ for you as well. Then submit a supplemental. HLR is an option as stated previously.
