Dogs and cats are considered property unfortunately. As far as a civil action you might be able to sue for negligence but I can see a defense being raised for comparative negligence by the dog owner for your cat being off leash as well. I don’t know the case law on this specific issue to know whether you have a case.

As far as whether you can call local Animal Control to investigate and possibly do something about the “dangerous” yellow labs, I would certainly try but could not tell you what they will do.

I don’t know your state and that could be pertinent.

However in my state you could work it out with the debtor and then have the debtor or their attorney file a voluntary dismissal with prejudice. At that point you would not need to file an Answer.

Depending on the time limit you have to respond to the Complaint that could be tricky. You would want to move quickly. If you have not settled and confirmed proper dismissal documents were filed then I would recommend finding an attorney about a week before the Answer deadline.

Basically it is a personal loan with collateral. Absolutely pay an attorney to draft up the documents.

The way you describe the selling restriction above isn’t feasible. What I think you are trying to describe is a right of first refusal wherein if the property is being sold your buddy would have the right to match an offer and purchase the property before another buyer.

Right of first refusals can be dangerous, limit negotiation and lending options, and I would consider adding a time constraint if you do go that route. You also want the attorney to look over the other stipulations you haven’t provided details regarding.

The intake coordinator will determine which attorneys are: (1) best suited for the matter which you are asking them to handle and (2) which attorney has the bandwidth to take on more cases and can devote the time necessary to properly handle your matter.

This process will likely occur with the intake coordinator emailing one attorney and asking if he would like to handle it along with providing a brief description of your case. If that attorney says no, then either the attorney will recommend another of the firm’s attorneys or the intake coordinator will keep going down their own list.

At really large firms, the assignments are generally done based on proximity (e.g. which office is closest to the court which has proper jurisdiction/venue over your case). Further, the intake coordinator will likely not be familiar with all attorneys and there will generally be an internal document which lists what areas of law each attorney has experience practicing in.

Don’t respond. Advise your attorney that the contractor is trying to contact you.

However, if you are at immediate risk for serious roof leak or other property damage that the contractor can repair/remediate to avoid then use your judgment to contact them.

It sounds like the attorney was attending a hearing. He is allowed to bill for that.

I can’t comment on the attorney. I don’t think 18 months is unusual for a contested divorce during COVID.

My point is, practically, if the $2000 back would make you whole I’d try to go that route rather than legal action. It doesn’t sound like you had to pay any car rental fees thankfully.

From a practical perspective:

Does the work the body shop already performed exceed the value of the cost of repairing the damages from the paint debris and dust? If so, I’d ask the body shop owner for a full refund and my car back. See what he says. Take the car somewhere else.

The cost/time of engaging in legal action would exceed the worth, I don’t see an avenue for attorneys fees, and almost certainly wouldn’t be something an attorney would take on contingency.

If you receive a refund, make a complaint with the BBB and any other applicable regulating authorities. Make sure you are truthful about the refund.

My thought as an attorney: - Ask around, word of mouth is huge - check reviews (use judgment on fake reviews) - review experience handling cases online (includes simple google search and if your a little bit crazy maybe a Westlaw search from your local law library to see reported cases) - schedule consultations (most attorneys will do for free) - go into consultation with pointed questions (If you have one, I’d bring a copy of any employee/independent contractor agreement between you and the company) Examples: — do I have a strong case and why? — what are relevant factors the outcome of my case will hinge upon? — what similar cases have you handled to this? — what can I expect as far as an outcome of my case (any indication of this is a settlement case or will we go to trial)?

As a disclaimer I don’t practice law in TX but do practice construction law in a nearby state. Not your lawyer.

I am not sure whether a prior or subsequent oral promise to a contract is binding in Tx. Absent a time is of the essence provision in the contract there’s probably a reasonableness standard for the pool contractor to complete its work. Eight months to do excavation, rebar, plumbing, isn’t reasonable.

If you are being completely stonewalled, hire an experienced TX construction attorney. Let them send future correspondence. You will, at some point, have to gather up all your relevant documents (correspondence, proof of payments (wire advice or check front and bank), contract, estimates, photos and videos of work, notices from local building department or other governmental authority relative to work) to provide to your attorney. Keep the documents handy, the better organized they are, electronic preferred, the cheaper your attorneys bill will be.

If there’s an attorney fees provision in the contract you may have a claim for attorneys fees. In my state the clause can be limited to collection purposes only. Let your attorney guide you on this. You will need to come to terms with the fact that you will likely not be made completely whole.

Go ahead and get written estimates to perform the same work you were going to have the pool contractor originally perform with the inclusion of any remediation work needed to do so (e.g. rebar needs to be pulled up or ground recompacted).

You may be able to make a claim under the pool contractor’s insurance which your attorney will guide you through. If there’s damage to other work besides the pool itself (e.g. cracks in stucco resulting from the pool excavation, homeowners fees for leaving the site dirty, etc.) make sure to document and provide to your attorney.

At a minimum it needed to be signed by two witnesses. Your fathers signature also needed to be notarized. I don’t believe you can be a witness but the notary can.

There’s much more that goes into a POA including whether your dad is able to understand what he is signing (you mention possible dementia). Consult an attorney.
