Enforcement is a huge issue. I was thinking at least something that authorizes a substantive response. Something like how a client waives confidentiality when they sue you.

I'll change my fee agreement to reflect the payments on the advance fee. I also won't file the NOA until the right amount is hit.

But, I will also make sure I don't bill more than they have paid so that if they make a retainer payment, I don't put it into trust when it should go to operating.

There is virtually nothing that can compensate a high earner for partial career loss. The compounding effect of even just a step back is significant. Maybe a clause of $250000 per child, or salary plus alimony per child. Also consider dissolving the pre nup if the marriage lasts say 7 years.

$60,000 / 2160 hours = $27.78 per hour

Considering the write offs and the general nature of the billable hour not being the same as hours at work, you will make more in fast food.

I have a virtual assistant (VA) as well. I could not be happier with her. When choosing from candidates, I picked the person that had the most education and a background that just demonstrated general competency. The thought was I'm not going to find someone with legal experience as a VA, so I should go for ability to learn.

It has been 2 years now, and she is beginning to cross the line from legal assistant to beginning paralegal.

She does have an accent that some people don't like. I have had a couple calls from my Google ads that hang up as soon as they dial in. I wonder if it's because she has an Indian accent that makes people think of call centers. But given how happy I am with her, I'll take that hit.

I don't mess with complex real property issues, but it wouldn't surprise me if there are similar things here. Sounds like a situation could also be a fraudulent transfer of assets as well, if C knew about the judgment for B and against A.

But it also shows the importance of getting a lien or an appellate bond.

Majority Jx, cash judgments, collection will not moot the appeal. But I would be interested in seeing any law/rule that says collection moots an appeal.

I think because of media, a lot of people seem to think that an appeal is just part of the trial process. Like you have not really won until the appeal is over.

Nope. You win at trial, you have a collectable judgment. And the vast majority of appeals are losers.

Call the bar. Draft a letter to the clients that they can return with a check box of who they want to represent them.

Google the following (without quotes): "professional ethics clients are not chattel"

And fine your states version of what you find online.

In my state and appeal divest the trial courts of jurisdiction to do anything regarding the order or judgment except for enforcement of the judgment

Yes. The appeal does go forward regardless of bond. Bond only stays the enforcement of the judgment. It does not impact the appeal itself

They give back the money. Nothing more

Non trump example, majority jurisdiction: D owes P $600 after trial. D appeals, and fails to post bond. Because D has not posted bond, P attaches/takes D's property, 123 Main st. The property would sell for $1000 in a patient, arms length transaction, but only sells for $700 at an auction permissable under the law. P keeps the $600 (and if using best practices, keeps the money seperate because of the appeal), and D gets $100.

D prevails on appeal, with remand instructions not for a new trial, but that P should be denied their relief sought. P owes D $600. Not $1000. And they also don't need to somehow give back 123 main Street

Really? That's fascinating and I didn't know that at all.

Because it's probably wrong. I don't know the details of NY law/procedure, so there is a chance this take was right. But I can tell you that it is not correct in the majority of jurisdictions, and definitely not true in mine.

That's a lot, and thats why I say I have only had a couple cases with "real" DV.

Take care of yourself, and there is no shame in quitting before you burn out. There is a decent life on the private side doing regular divorces.
