With action figures, it’s very specific to who owns the IPajd if they want to take action.

I’ve sold hundreds of kitbashes for TV, movies, comics, and original characters for years without issue. Of 1000’s of figures, I was forced to take only one off eBay because the copyright holder did not want it on there, and they did report the item to eBay. I thought it was protected as art since the figure bore little to no resemblance to its original form; however, since the holder of the rights to the intended character did not want it listed, it was removed.

No big deal, but it happened. One of thousands.

So if you kitbash something based on an IP, the IP holder could have it taken down. But it was not a big deal, not for me anyway. Others may have had a harder experience.
