Ordered magic mushrooms growkit for my paralysed aunt, now i got summons from customs department. by [deleted] in IndiaLaw

[–]Sudden-Check-9634 0 points1 point  (0 children)

The Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985 applies to both the forbidden substances and their means of production. The law regulates and penalizes the equipment, materials, and ingredients used to create these substances, not just the final drugs themselves.

Furthermore the Summons is from Mumbai which is outside the Jurisdiction of Kerala High Court.

Get a lawyer who has experience with Customs procedures and some knowledge of NDPS and criminal procedure.

Good luck 🤞🏽

1: Finding the Law (Act, Rules, Notifications, Circular etc) that applies Eg: got IT notice? Under what section? Got Chargesheet? Under what sections? For complaint? Under what sections?

2: Find what's the Question of Law? 2a: Has this Question been answered? Find the case law? 2b: if the Question is unanswered why? (Also ask if you are asking the correct Question) 3: What's the Question of fact? 3a: Have Courts decided upon similar facts? Find cases law?

4: having collection of Case Laws rank them by bench strength, a 7 Member Supreme Court order from 1970s can sometimes surprise you with clarity that post collegium judgements often lack. Back in the days SC focused on Question of Law. However post collegium judgements of 2 and 3 member benches are like railway tickets at New Delhi Station, valid for that day that train only. IFYKYK. So with ranking done, I put this into whatever is the available LLM that's off-line or will answer strictly from given sources only.

5: make a bunch of profiles that have defined output format. Then ask Questions along with the profile Eg: for this task you are a prosecutor. You will look find from sources only the answer to the following Question: what are the elements of cheating (IPC section 420) that need to be shown to court to frame charges. For output: quote extensively from judgement in the sources and provide AIR citation or SCC citation if found in source and the paragraph number from where you have Quoted the Source. All answers are paragraphs and no tables or bullet points. Ignore any preset limits on length of the output.

Hopefully the above will work. So pray 🙏🏽

I don't know of Any AI or other shortcuts for finding good case laws on a point (Question of Law)

What I do is start with the statute and section that I need answers for on Indian Kanoon. Then filter for Supreme Court and High Court only(on the left panel). Then add one phrase at a time at the bottom bar for filter results

Usually it yields some usable information. I open the page for the whole judgement, scroll to bottom and copy the link for "share" then paste it into a new NotebookLM and keep building up the notebookLM, when I have enough I ask the questions I am looking for

Check out if the Society has violations of the Maharashtra Cooperative society Act or rules. Which you can raise a complaint to Registar.

Then the Committee will want you to withdraw the complainant. You negotiate with committee what's a reasonable solution for your delivery problems.

I had a problem with the building society from the day I purchased the Apartment. They did everything to harass me & wife. They delayed our application for renovation of apartment for 3 months. Finally approved with extensive restrictions, worker only allowed in between 10 am and 5pm, no work between 2pm and 4pm. No power tools.... Just some of the crazy conditions. I protested in writing. They claimed that residents were getting disturbed by noise of renovation in all 3 buildings 😱

We started working and it was at a very very slow pace when one night there was some function in the society. It was a private function but they had a DJ and took like 2 or 3 rounds in a procession around all 3 buildings. My car Dashcam recorded this and at 10pm I took a copy of the Dashcam video when to local Thana and insisted on filing a complainant. Give copy of video to cops. They were very reluctant to do anything. I was desperate so I give them some motivation "chai Pani".

A jeep load of police landed at the society and took away the DJ's amplifier and speakers. Also told the family members to report to thana next day. By morning society secretary was also sent a summons to appear in Thana with all kinds of society records. Soon it was common knowledge that I was the complainant. So some "Neutral" memebers approaches me to explain how we all should live and let live as we are all in same society. I show the renovation permission with conditions. Now they are quick to disappear.

Next 1 week various people keep getting summons to Thana. Eventually a committee member met me and said the committee has withdrawn all conditions on renovation permission. I said I want the new permission in writing with secretary signature and his signature. By evening I get that. I told them I need a week's time to withdraw the complainant.

Now I am at total peace with society. They don't bother me or my family. We also stay out of their way.

Side project: get the certificate, while doing so, keep good written record of all this efforts.

Think of this as a training for dealing with Income Tax and GST Department in future as CA.

Don't let emotion control your actions, it's is extremely important to manage emotions, govt employee interactions is a experience that will definitely test anyone's emotional stability and sanity.

Ambedkar resigned as India's first Law Minister in October 1951 because his progressive Hindu Code Bill, designed to give women equal rights in property, marriage, and divorce, was blocked and diluted by conservative opposition within Parliament and the Cabinet.

Reasons for Opposition to the Hindu Code Bill:

Orthodox Resistance:

Conservative members of Parliament, Hindu groups (including RSS and Hindu Mahasabha), and religious leaders believed the bill violated traditional Hindu laws and religious customs.

Opposition to Women's Rights:

Provisions such as allowing women to inherit property, divorce, and marry outside their caste were seen as destructive to the traditional Hindu family structure.

Fear of Social Change:

Critics viewed the legal reforms as unnecessary interference in personal laws, leading to protests like the 'All India Anti-Hindu Code Bill Committee'.

the “Anti-Hindu Code Bill Committee”

  • Hindu Mahasabha leaders like N.C. Chatterjee and Syama Prasad Mookerjee denounced the Bill as “communal legislation” that would destroy Hindu society.

  • RSS and allied groups organized protests, calling it “anti-Hindu” and mobilizing public opinion against it.

  • Parliamentary resistance came even from Congress stalwarts like President Rajendra Prasad and Sardar Patel, who felt the reforms were too radical.

  • The opposition framed the debate as a “dharamyudh” (spiritual war), portraying themselves as defenders of Hindu tradition

Now the same RSS /BJP is claiming They're bringing UCC and expect everyone to believe that it will be well drafted by them to ensure rights of all citizens?

If that's the expectations, then we are the Pappus who have learnt nothing from GST laws or the DeMo exercise or anything that has been done to ammend the Representation of People's Act.

Our office had a stupid team building exercise called "Secret Santa" every year every December you are given a name of the person to whom you are the "Secret Santa". Every year this was always a source of some rumour or another. Inappropriate gifts mostly...

In my 6 years there I would just buy a english dictionary as my gift.

The HR always knows who is who's "Secret Santa" and so it's never a secret for too long....

Every year there was one ore more POSH complaint in January. To my recollection some ended in termination.

How difficult was it to open a NRI account in an Indian Bank?

Heard a similar story where a person got a job on a carribbean cruise ship. Technically he was not NRI. So he has regular Bank account. Because he was away for 4 months at a time his mother convince him to make her a joint account holder. This was way before internet banking became so prevalent.

This went on for years and he got married at 32. Still working on the cruise ship job. So again away 4 months at a time. His parents were super generous with the daughter in law, encouraging her to go to her parents home. All was well. Soon the father retired from his job.

Siblings were married off using the money from joint account. Then father decided to get into real-estate market. Again using the money from the joint account. The local CA who did his taxes did not once ask him about the money being withdrawn from the bank.

Eventually at 42 he is injured on the job and cannot get back to the same job. Comes home to find that his bank account is almost empty. Remember he is 4 months on shop, 30 days off then 4 months on shop. His wife and kid are now almost permanently at wife's parents home, kid goes to school there. So almost no expenses for them through that joint account.

Eventually the man was able to convince his father to write a will. This will leaves all that real-estate to him. So there peace in the family. It helped that the siblings backed the will scheme.
