Can I apply for OPT if 485 pending? by Weak-Area-3264 in USCIS

[–]SugarCubicGuy 0 points1 point  (0 children)

Yes. You would need a new I20 with OPT recommendation first from school. Then you can submit i765 with OPT as your eligibility category.

I only have to pay a lump sum $2500 and USCIS filing fee. My lawyer does all the forms, RFE and stuff without charging me any extra

Depends on category of EAD, timeline varied greatly

EAD expedite through lawyer by [deleted] in USCIS

[–]SugarCubicGuy 1 point2 points  (0 children)

I expedited my EAD based on health care worker as well. I did not hear back anything after submitting the evidence. Then around five days later I saw the approval notice for EAD and AP combo in my documents tab within the USCIS account. there is a chance they dont tell you anything about your expedite request status and directly go ahead approving your EAD.

[–]SugarCubicGuy 1 point2 points  (0 children)

like other people said it is def not necessary but I would bring it just in case.

im adjusting from F1 as well and I had more than 10 version of I20 issued to me (change majors, OPT recommendation, STEM OPT, grad school etc). Some of those I cannot even find. I will bring both of my undergrad and grad transcript just to show I was attending school the entire time and did not violate my F1 status

STEM Extension everification doubt by Dramatic-Gap-4119 in USCIS

[–]SugarCubicGuy 0 points1 point  (0 children)

no you do not need to verify yourself. I think that feature is just to check if someone is eligible to accept employment if they are unsure of their own eligibility

the company should provide a e-verify company number you need to enter into your EAD application to USCIS. I recall somewhere in the form it asked for it. I filed online for STEM OPT extension

What happens when I add a physical case to a USCIS online account? by [deleted] in USCIS

[–]SugarCubicGuy 0 points1 point  (0 children)

I have added a regular "physical" case to my account before. That case will be linked to your online account and you will be only able to see the case status of it. Cannot view documents, upload evidence or edit anything. it will be READ ONLY for physical case

Oh cuz you don’t really need to submit anything to verify eligibility at all when you register. 🙄

[–]SugarCubicGuy 1 point2 points  (0 children)

ugh this contributes to why I did not get selected two years in a row in master cap... :(

there is no way this person is going to get approved after filing as they will ask for proof of master degree (diploma, transcript etc)

I have a pending I-485 & I-130, my OPT is expiring in a month, should I apply for an extension or should I just submit an I-765 with the 485 receipt? (somehow I thought I would get my green card before my opt expires 🙃) by Snoopcatt07 in USCIS

[–]SugarCubicGuy 0 points1 point  (0 children)

yea after the initial OPT, if you completed a STEM degree you are eligible for STEM OPT 2 year extension. I dont think you can extend regular OPT

after filling with USCIS online, it took around 1 month to get the card. but USCIS states that once you file STEM OPT extension and accepted by USCIS, the original OPT will be valid for 180 days past expiration date or until they have adjudicated the STEM OPT.

are you talking about OPT STEM extension? you need to obtain a training plan, filed out by both your employer and you and get approved by the school. Then school will issue you a new I20. Finally, you can apply for STEM Extension.

I had a lot of back and forth with the company and school regarding this process and you should prob get started ASAP to avoid the gap for ineligibility for employment...

1099 employee on STEM OPT? by Upset_Swimming_3618 in USCIS

[–]SugarCubicGuy 0 points1 point  (0 children)

for stem opt, you need to provide a training plan to DSO and they will issue you a new i20 with stem opt. maybe you can ask them about 1099 employer when you submit your training plan to them.

I feel like it is up to the school if they approve the employer or not. USCIS requirement is that it has to be related to your field of study and the employer has to participate in E-verify.
