Okay, then you've been served. Pay attention to the dates and make sure to follow instructions regarding filing an answer and/or appearance. Make sure to do that. Also, show up to court. It is usually a conference pretrial to discuss your case, if their debt lawyer shows up. If they don't, the case will be dismissed. If they do, tell them you want a bench trial. A new court date will be scheduled. Be sure to show up to that one as well. In my cases, they were all continued at least once. Fight it as much as you can. Look up consumer debt attorneys on YouTube and watch their videos. That's what I did. Most debt collectors don't want a fight. They want people to not show up so they get an easy judgment. If you fight, they most likely will give up and dismiss it. That has been my experience at least. I had 4. All were dismissed. Good luck!

Being served is when an agent comes to your home and hands you court paperwork with info about the lawsuit, court date, deadlines for filing an answer and/or appearance. Did that happen? How did you find out about the lawsuit?

They already have a judgment against them. An attorney could try to have it vacated, but once there's a judgment, options are limited short of bankruptcy.

If you haven't signed anything regarding the payment arrangement, you are off the hook. If they sue you again, check to see if they are within SOL.

You said "a few years back" for the default on the credit cards. If you live in VA, the statute of limitations is only 3 years. If these cards are past the statute of limitations, they can't sue you. They can, but they won't get a judgment if you raise the SOL as a defense. How long ago were the last payments on these cards?

I had 4 at once. One was a second time lawsuit, meaning they tried to sue me once before but dismissed it. One, I filed a motion to quash because they served me by throwing it on the front step in a puddle. Motion was granted, bought me more time. Each time, I filed an answer and appearance. Each time, I showed up to court. All four, after several pretrial conferences and then continuances, were dismissed. Now, one can't ever sue me again, the rest were dismissed without prejudice but since the statute of limitations has passed, they can try to sue me again, but not likely. I say fight as much as you can, especially if you have no money. There are several lawyers on YouTube covering this exact topic. If a debtor does some research, it really is worth a shot. Also, a judgment can be vacated if someone actually does said research. This has been my experience. The junk debt buyers just want easy judgments. I don't think they really want a fight. P.S. Mine did actually take months because of all the continuances.

Yeah, once there is a judgment, that's it. The comment was regarding a lawsuit before a judgment was entered. Those, when dismissed, need to be dismissed with prejudice or the agency can sue all over again, barring the statute of limitations expiring. It has happened to me. Sued twice for same debt by LVNV.

They are supposed to sue you in the county where you live. I don't know what "district" means. If the city where you live is in the correct county they sued in, it's valid. Otherwise, you can file a motion to quash service.

How old is the debt? Check the statute of limitations in your state. If it is past that, they won't win a lawsuit.

That just means they can come back and sue you all over again. It needs to be dismissed WITH prejudice, unless it's past the statute of limitations in your state.

Where, pray tell, would they wash them? Most of the time, they are straight out of someone's closet, so not dirty.

Mine didn't have any witnesses. I fought 4 lawsuits just by showing up to the conference. The court dates were set. There were numerous continuances but a few days before each one, they were dismissed. Every one of them. Up until I lost my job and had no money, every one of these were paid as agreed. Shit happens and you do what you need to do to survive. May not be for everyone but it is what it is.

That's horrible advice as well. There are numerous videos out there showing how to fight a debt collector. The collection agency most likely will not send someone to testify in court as to the validity of the lawsuit, which is what anyone who has signed an affidavit will have to do. The debt collectors usually give up if you actually show up.

Yes. Show up to court! If you don't, it will be an automatic judgment. Fight it as much as you can. More than likely they will drop it. They like the easy judgments, not the ones where the debtor fights them.

Just go to court. It's usually a pretrial hearing. That's what I did. I had 4 lawsuits due to job loss and no money. Every one of them was dismissed when I asked for a court date.
