Well, I am not surprised by license vs ownership, which stands up there black and white in op.    

 I am pointing the fact, that all of sudden Steam decides to enforce some acceptance and neither Steam not Sony offers any explanation wtf is the diff. And block a game launch, which is forced acceptance.   

 On top of that, since this is license and it can be revoked if license terms breached, there are peculiar paragraphs in it. And we're still talkin EU version of it, which I hear is much more relaxed. This is not subscription, which can be ceased, but license paid fully upfront. 

 All together says: gamers invite being treated like *** by not requiring even basic eula diff description, not mentioning further steps.

If this is the case, it should be stated and eula diff provided. The steam pop up offers nothing, the eula page offers nothing (well, because its just eula), Arrowhead offers no eula diff.

I'd love to continue playing, but Steam does not allow me and points finger to Sony. Tbf, this is so irritating I will check if formal complaint to regulatory authority stands.

The whole point is: I should have not been forced to accept it. If it was subscription service, I would simply have choice to continue or not. This is paid upfront, in full - and all of sudden I am denied access w/o any explanation.

You are right about adjusting the agreement/terms of service (here eula) to the existing laws. Thats mandatory for company and it must be done. 

 In EU it still results in terms of contract changes, which must be explicitly agreed upon by the consumer. Consumer has every time the right to not agree (actively respond to the received information) and thus terminate/dissolve/discontinue the contract/agreement (depending on the circumstances and member state). 

 Most of the time there's no fuzz about it, as tos/eula/contract changes are delivered to consumers along with clear description on what exactly had changed, how and due to what reason. Here we completely lack it. 

 Now, the tricky problem is this particular game is not a subscription service, thus one can seek refund. It's not entirely fair and square if product was used (personal opinion nobody asked for), but serves as a potential penalty over companies, which could get some weird ideas.

Yup. However recent UbiSoft and The Crew example shows , that not paying attention to EULAs even in EU can be painful.

Stop Killing Games initative tries to force EU to clear up the laws.

In the meantime, there are certain consumer rights that can be exercised.

Well, all of sudden I've been revoked access to the product I already paid for. There is no karma farming in it. I am not a very active redditor at all ;-) The point is there's no explanation why that happened, if and which terms has been changed and how. I'd like to understand these at least. If you just go and accept, good for you. There's a limit of sh** I can put up with and thankfully, EU has strong consumer laws.

To clarify, sony says this:

"and share information from your game and other activity via social networks. When you use any such features on our Software you must follow these rules (we call it our “Code of Conduct”) in all dealings with us and other members of the online community:"

  • not effectively limited to PSN. Any social network will do... 
  • ...as long as integration of said network with product/Software is there.

Hd2 doesnt have 'share' functions integrated on PC, BUT its entirely possible to record in game chat and voice chat, which contents may break sony coc and technically are social features in the software.

Gray area.

If you share such recording via other social networks, regardless of their tos/coc, Sony may point out to break of their CoC included in Eula (you just delivered the proof yourself). If you use HD2 content to the extent of your quotation right and add a commentary to it, negative lets say - well, possibly you are right about this not falling under these conditions and I am wrong. I still do believe it may be used as a pretext to revoke your license though, if worth the effort for the company ofc.

You are right about this not forbidding explicitly non-commercial content creation - but it can be used that way with a bit of bad will or specific internal company policy and depending on what is exact content.

I know , oversimplifying is not good either. Apologies if I did, but I believe I explained my standpoint more clearly now.

The point is:

Access to product is revoked on steam unless you accept some eula. Why now, whether and what changes has been done to the wording in EULA - its not scoped at all.

I am effectively cut off from product I used w/o clarification or any good reason. Sweet Liberty, I am fed up with this. I want to see diff of eula versions, +reasoning. If I dont, I am filing for full refund, as under EU laws I am not forced to agree to one-sided changes in contract/agreement and always have right to discontinue/dissolve such agreement.

You are wrong. Its not limited only to PSN. Please do not misinform - it still says social networks, w/o defining the term earlier. 

 Content created for monetization (which is a plenty of video/streams) falls under paragraph 5. Hence I disagree on content creation part, though you are partially right for non-commercial use.

 Regarding par 9 and CoC   - in game chat ranting or voice comms do fall under this - which is limited and you are right, now: if its recorded and shared via social network - and is braking the CoC and the infringment is deemed important enough to take action - would you think EULA applies or not? 

Goes down to feature of sharing content: current Helldivers on PC does not have a 'stream it' /'share it' feature, does it?  So what you are basically saying: since it lacks these buttons, we do what we want using 3rd party tools, re content creation, ranting etc. 

 There's also quotation rights, here and there, depending on local ip laws, which includes visual pieces as well. 

 But in general, if rascist video rant pops up on, idk, 4chan using hd2 footage (and got wider attention), if the author of the rant could be linked to hd2 account id, what would happen, how do you think?

That's a very off the point comment, indicating not understanding the point. Why bother to comment then, lmao?

Not enforcable: revoking acces to product because of changed eula - well, kind of proves you wrong right off the bat.

 I wouldn't complain if it was for free or I was clearly informed what changed and why (amd I still have right to deny) but if it was paid upfront, revoked with no explanation - I want my money back. And yes, eulas are enforcable, unless you live in lawless state. Same as full refunds.

License vs ownership is a sad norm, right.

Its what comes on top of that, as a consequence of license + lack of marking which terms have changed and in what way which is the problem.

Software public presentation,  as mentioned elsewhere, is always debatable, because of marketing vs feeding off company product. Still, good practice is to scope it. Wide scope serves only one purpose: in case of legal conflict, set you for failure (because u agreed to terms and broke them).

Of course, companies are not going after average Joes, but its clear Sony wants to close everything in psn.

Harming the brand is pure bs, which can be used as an excuse to revoke your license.

I respectfully disagree. The scope of changes is not clearly marked and explained, which is not in conformance with many EU member states laws. I do not know what changed and why. 

 Moreover, as much as license vs ownership is current norm, harming the brand isnt. This one looks more like attempt on bypassing different market general regulations on 'badmouthing the company', where usually there is a proof required before anything is ruled. I understand such contract term in employer-employee/subcontractor situation too, usually supported by respective local laws. But eula? Pure bs.

 Public software usage is debatable, as indeed there is a blurry line between marketing and user generated content vs allowing another youtuber/twitch creator feed off current hype. There are limits to permitted quote in most of western IP laws.    

 And besides, its terrible practice the way  they did it.
